Murdered Arizona Judge Stood Firm With Sheriff Mack

During the hours following the Tucson tragedy, as the details slowly emerged and we learned that a relatively unknown congresswoman was seriously wounded and a federal judge had been among the six killed, many Americans wondered if there was a specific target and who that might have been. More importantly, why was Rep. Gabrielle Giffords (D-Ariz.) getting all the ink while Judge John Roll remained virtually unnamed for a whole day? In this business, we at AFP long ago learned to read the white part of the newspaper.

We were in good company. Even Texas Republican Rep. Ron Paul’s daily Internet news release was asking the same questions the following week. Next, former Arizona Sheriff Richard Mack* came forward with illuminating information that none of us remembered: Judge Roll was one of the few “good guys” on the federal bench. He had ruled favorably in Mack’s case against the Brady Bill in 1994 when Mack had sued the federales for trying to force him and all the other sheriffs in America to do their work for them.

Mack took it all the way to the Supreme Court where he finally got the reversal in 1997 and forced the rewriting of the far less intrusive Brady Bill.

But earlier in the game, he found himself in Roll’s federal courtroom fighting a provision in the new statute that threatened to put him in federal prison. Mack says that Roll seemed sincerely concerned about federal power to arrest any sheriff that failed to comply with the federal mandate, even though then-Attorney General Janet Reno had said that the bill’s language was aimed at gun shop owners and not the sheriffs.

Roll granted Mack’s injunction against the government for any arrest for failing to comply. Then the prosecutor told the judge that in only the first four months of enforcing the Brady Bill the government had prevented over a quarter million felons from gaining access to handguns. Disregarding the audacious exaggeration of numbers, Roll further impressed Mack by telling the prosecutor, “Counselor, do not pretend in this courtroom that your statistical analysis somehow equates to constitutionality.”

Mack tells us what Roll included in his ruling on the Mack v. US case:

The court finds that in enacting [the Brady bill] Congress exceeded its authority under Article 1, section 8 of the United States Constitution, thereby impermissibly encroaching upon the powers retained by the states pursuant to the Tenth Amendment. The court further finds that the provision, in conjunction with the criminal sanctions its violation would engender, is unconstitutionally vague under the Fifth Amendment of the United States Constitution.

“Judge Roll,” writes Mack, “of all the dozens of judges who had heard this case from me and the other six sheriff defendants, was the only one who ruled that the Brady Bill violated the Fifth Amendment as well as the Tenth. It was pursuant to Judge Roll’s insight and sensitivity to the threat this ‘law’ posed to us, the sheriffs, that this case made it to the U.S. Supreme Court.”

Further into the decision, Mack saw Roll display another principle and said, “It truly brought me to understand how astonishing this man really was.”

Roll had said, “Mack is thus forced to choose between keeping his oath or obeying the act, subjecting himself to possible sanctions.”

“I have to say that Roll’s understanding of principles amazed me,” Mack writes today. “He was so professional and knowledgeable. He took his job and the Constitution so seriously.”

Pima County, Ariz. Sheriff Clarence Dupnik’s ridiculous blaming of conservative talk show hosts was reminiscent of the same cover-up ploy at Oklahoma City in 1995, but his public statements regarding Roll having just dropped by to say “Hi” and his being “in the wrong place at the wrong time” may merit further examination considering there have been some questions about who will have jurisdiction over the crime—the state or the federal government.

FBI Agent Tony Taylor filed an affidavit with the court swearing that he saw Roll chatting with Gifford’s congressional aide, Ron Barber, for several minutes prior to the shooting, and that Roll had been notified by telephone of the Saturday rally on Friday. Roll was apparently at the rally to discuss illegal immigration and the extreme caseload imposed on federal judges in Arizona largely related to immigration cases.

In 2007, it was revealed by reporters in Texas that unmanned drones were being used in supposed border control operations.  We detailed that report with supporting evidence that drones clearly were being used inland away from border control functions.

Recently, an article from Miami-Dade announced the arrival of a 16-pound micro drone T-Hawk surveillance model designed by Honeywell. The video below shows a more detailed view of the capabilities of this surveillance drone.  Keep in mind, this is only what is being announced at the moment, which has nothing to do with the massive amounts of R&D that has being going on to reduce the size of flying surveillance.  There have even been reports about “wasp” drones to sniff out Wi-FI networks as well.

Pending FDA approval these specific unmanned aerial vehicles are set to be used domestically throughout the United States. Besides the obvious uses for these drones such as during a legitimate raid, these drones may be used in order to further the police state and restrict free speech in America.

“At this point, domestic UAV operations are extremely limited. But with the astonishing growth of the industry and the efforts of AUVSI, the UAV Caucus, and others to loosen FAA restrictions, we can expect an explosion of use by local and federal policing agencies in the near future. such as political protests. This is simply another push towards a complete police state.”

What will be considered anti-social behavior remains to be seen but if the ever involving police state is any indication these drones will be used to spy on citizens against the private Federal Reserve, Obamacare, and the New World Order.

This information is right out there in the open yet it seems that the American people are once again asleep at the wheel. Where are the widespread protests against the aerial surveillance of any American that the corrupt federal government chooses to set their sites on?

We’re clearly entering some sort of science fiction reality where anything seems to be possible.  We have flying vaccines on the backs of GM mosquitoes, as well as the imminent arrival of nanotechnology and nanobots in our daily lives, which only portends more nightmarish developments from the Department of Defense.  But here is the latest from Honeywell, a huge military contractor working with DARPA:

FIRST, THEY CAME FOR BRADLEY MANNING

(LOS ANGELES) – While the country responds with growing alarm over  torture policies first instigated against prisoners in Guantánamo, policies which now appear to be levied against at least one American citizen, Bradley Manning, another policy violation has been overlooked by the guardians of our freedom. The U.S. press has been mum, at least up until now, on the violation of the Biological Weapons Convention by none other than the United States government.

In the rush to pass protective legislation into law following the attacks of 911, the authors of the U.S. Patriot Act amended the previous legislation regarding biological weapons. Section 817 of the U.S. Patriot Act, otherwise known as the “Expansion of the Biological Weapons Statute,” has violated the Biological Weapons Convention, an international treaty which the U.S. signed in 1974.

The Biological and Toxins Weapons Convention, also known as the BWC, was the first multilateral disarmament treaty banning the production of an entire category of weapons. It was largely considered to be a result of prolonged efforts by the international community to supplement the 1925 Geneva Protocol.

The language of 817 closely mirrors that of the BWC, which bans the development, stockpiling and transport of biological weapons. The violation has occured in a final caveat, which nullifies the prohibitions contained in the BWC and prior U.S. bioweapons legislation.

After paragraphs of assurances as to the criminal penalties involved in violating Section 817, the U.S. government granted itself the freedom to violate any and all prohibitions contained in the section.

Here is the section of 817 where the violation takes place:

“(c) Whoever knowingly violates this section shall be fined as provided in this title, imprisoned not more than 10 years, or both, but the prohibition contained in this section shall not apply with respect to any duly authorized United States governmental activity.”

THE SPIN DOCTORS CLIMB ON BOARD

This reporter stumbled upon this violation in the process of researching arms treaties where the U.S. was a signor.  Upon discovery of this violation of the BWC, the United States Department of Justice was contacted.  Dean Boyd, Press Officer for the DOJ, wrote this reporter that ”we disagree with your conclusion that the statute enacted by Congress is a violation of the letter or spirit of the Biological Weapons Convention and, with all due respect, believe your interpretation of the law is misconstrued. Please see 18 USC Section 175(b).”

18  USC Section 175(b) is, in fact,  the law that was amended and thus superseded  by Section 817 of the US Patriot Act. When Boyd was informed of this in a subsequent email from this reporter, he hunkered down and replied  “we have no further comment for you on this matter.”

On January 12, 2010 The U.S. State Department was contacted for comment as well. As of the time of going to press, over two weeks later, Sandra Postell at the State Department has stated that “We are working on your request; we have multiple offices working on this which is taking more time than anticipated.“

According to a United Nations spokesperson, that body is not the repository of the bioweapons  treaty. The repositories are Great Britain, The Russian Federation and the United States of America. Both Great Britain and Russia were informed this week of the violation by their colleague.   At the time of going to press neither country has responded.

WEAPONS INSPECTORS, ANYONE?

Concern is heightened by indications that the U.S. may be planning on deploying these banned weapons. Sources have disclosed that these weapons may, in fact, be stockpiled at a military base in Herlong, California/Nevada border.

The particular language of 817 also raises concern that there may be attempts to deploy domestically. This concern focuses on the list of restricted persons named in 817. “Restricted persons” are those who may not possess or transport biological weapons. Due to the fact that the “restricted persons” list does not indicate an overseas military operation, the argument is strengthened that there is intent to deploy domestically.

The intersection between bioweapons and what are colloquially termed “ethnic bombs” reveals an area of genome research where these weapons  might be developed and deployed covertly, under the mantle of “plausible deniability.”.   Vincent Sarich and Frank Miele, authors of Race: The Reality of Human Differences, published in 2004, believe that information from the Human Genome Project will be used in just such a manner.

WHAT WE SAY VS. WHAT WE DO

The official declaration of the United States government concerning Title 18 USC 175 (the old law which was amended by 817) follows:

Section 2 of Pub. L. 101-298 provided that:

“(a) Purpose.–The purpose of this Act[see Short Title note above] is to–

“(1) implement the Biological Weapons Convention, an

international agreement unanimously ratified by the United States

Senate in 1974 and signed by more than 100 other nations, including

the Soviet Union; and

“(2)
protect the United States against the threat of biological terrorism

By amending the law in the manner discusses herein, it is possible that the U.S. has violated both original intentions: we have clearly signed off from the international treaty and may very well  have signed off from protecting U.S. citizens from a bioweapons attack.

The primary authors of the U.S. Patriot act were Viet D. Dinh,  a lawyer who served as the Assistant Attorney General of the United States from 2001 to 2003 and Michael Chertoff, formerly the head of Homeland Security.

TSA shuts door on private airport screening program

A program that allows airports to replace government screeners with private screeners is being brought to a standstill, just a month after the Transportation Security Administration said it was “neutral” on the program.

TSA chief John Pistole said Friday he has decided not to expand the program beyond the current 16 airports, saying he does not see any advantage to it.

Though little known, the Screening Partnership Program allowed airports to replace government screeners with private contractors who wear TSA-like uniforms, meet TSA standards and work under TSA oversight. Among the airports that have “opted out” of government screening are San Francisco and Kansas City.

The push to “opt out” gained attention in December amid the fury over the TSA’s enhanced pat downs, which some travelers called intrusive.

TAMPA, Fla.—Police say a 50-year-old woman has been charged with shooting and killing her two teenage sons in an upscale suburb of Tampa, Fla.

Tampa Police spokeswoman Laura McElroy man said Friday that Julie Powers Schenecker faces two charges of first-degree murder in the deaths of 16-year-old Calyx Powers Schenecker and 13-year-old Powers Beau Schenecker, 13. McElroy said Schenecker admitted to the killings.

It happened in the upscale northern suburb of Tampa Palms. Police believe they were killed Thursday.

McElroy said police responded at 7:45 a.m. Friday to a call from relative in another state who was concerned because the family couldn't be reached. Officers found Julie Schenecker on the back porch.

Schenecker's husband is a U.S. Army colonel serving in Qatar.

In Tunisia, the president had to escape to Saudi Arabia under the cover of darkness while masses faced an embattled police force on the streets of Tunis.

 

In Lebanon, the regime of Saad Hariri collapsed and a pro-Hezbollah Prime Minister was appointed in his place.

 

In Egypt, for the first time in modern history, thousands of people took to the streets in protest in every city along the Nile Valley.

 

In Jordan, Muslim brotherhoods are calling for a national strike. All of this does not bode well for Israel's future.

 

While everyone is afraid of Iran's build up of nuclear weapons -- bombs that are capable of reaching Israel -- Iran is not waiting for a nuclear bomb. Instead, they are stirring up trouble on every side of Israel's borders. Iran's cruel and cunning calculations are as follows:

1. There is anger and frustration among the populous of Arab countries due to dreadful economic hardships. So the Iranian minions are traveling far and wide to stir these pots.

 

2. Iran is convinced that the American administration has proved either unable or unwilling to take a stand in support of these secular Arab governments.

 

3. Iran also knows that Islamic brotherhoods and movements in Arab countries are far less concerned about the Sunni/Shiite division between them than the hatred for secular governments and for Israel.

All of this creates a perfect environment for toppling current regimes and replacing them with anti-Israeli militant Islamic governments, thus tightening the noose around Israel's neck.

 

This could all be wishful thinking on the part of the Iranian power-hungry and maniacal regime. For Israel could easily annihilate Iran's military power from the air. But they would be extremely hesitant to do so without the support of the American administration, which has flatly told them to "stay put." If the Israelis go ahead and attack Iranian installations, this, no doubt, would create a public relations nightmare for the Jewish nation.

 

While my analysis of this situation originates primarily from my sociological background, my gospel preacher instinct knows that Jesus Christ is the only answer to man's trouble. And that is why, two years ago, I launched a satellite television channel that is currently beamed directly into these troubled areas, as well as into Europe. Available to 140 million homes, it brings the message of love, forgiveness, and peace along with a prayer from our hearts that the Gospel would change not only lives, but societies.

The Solar Dynamics Observator caught nearly simultaneous solar eruptions on opposite sides of the sun. Recent research suggests the activity might be linked.

John Roach says: A spectacular double eruption on the sun was captured today by NASA's Solar Dynamics Observatory. The eruptions happened nearly simultaneously on opposite sides of the solar disk, SpaceWeather.com reported. The plasma clouds produced by the event are expected to miss Earth, so there's no threat to us or to satellites orbiting the planet.

On the lower left in this image of the sun, a magnetic filament erupted, and on the upper right a departing sunspot produced the strongest solar flare of the year so far, an M1-class event. The double whammy may be more than a mere coincidence: Recent research suggests that solar activity is interconnected by magnetism over large distances, and that solar storms can go global.

Delaware: Death Cause Revealed for Man in Landfill

A federal military consultant whose body was found in a landfill was assaulted and died of blunt force trauma, the state medical examiner’s office said on Friday. Officials offered no other details about the death of the consultant, John Wheeler III of New Castle, Del., whose body was found in a load of trash that was being dumped at a Wilmington landfill on Dec. 31. Officials had determined several weeks ago that Mr. Wheeler was a homicide victim, but they withheld the cause of death until toxicology tests were completed. Mr. Wheeler, 66, was seen on video surveillance cameras wandering around downtown Wilmington in a disoriented manner in the two days before his body was found.

An emergency medical technician was busted Friday for stalking a patient he met in an ambulance, officials said.

Ansar Ali, 50, allegedly took down the woman's personal information when he helped transport her to a Queens hospital on Dec. 26, said Rose Gill Hearn, commissioner of the city's Department of Investigation.

The paramedic had the woman state whether she lived alone and had her tell him her work schedule. Ali then slipped her a note asking if he could call her sometime, officials said.

She declined his request, but the creep rang her phone anyway - even threatened to call immigration officials if she didn't return the calls, officials said.

On Jan. 6, Ali - who has been employed by a private hospital since last November - knocked on the woman's door for 90 minutes, demanding to be let in, officials said.

Ali, of South Ozone Park, Queens, was hit with coercion, harassment and stalking charges.

Buddhist Monk Could Serve Jail Time Under Bhutan's Anti-Smoking LawBhutan has some of the toughest anti-smoking laws in the world, and police can now enter homes if they even smell tobacco. And last week, police arrested the first person under the new law: A Buddhist monk.

The monk was arrested with 72 packs of chewing tobacco, according to Reuters, which he bought across the border in India and smuggled back to Bhutan. The unnamed monk says he had no clue abut the new law, which could put him in jail for the next five years if convicted.


He can be charged with smuggling of controlled substances, which is a fourth degree felony," a police official from the Narcotic Drug and Law enforcement Unit of Bhutan, who did not want to be identified, told the Bhutan Today newspaper.


Damn, that's pretty harsh, no?

These maps are very exciting. But it's hard to imagine how, with so much hyperbole thrown at normal storms, Accuweather is going to convey the seriousness of an actually catastrophic weather event, like a hurricane. Maybe they'll use a giant red skull ringed with fire, indicating the path of the hurricane with a speech bubble issuing from the skull's mouth: "ABANDON HOPE, ALL YE WHO ENTER HERE."

In all his years as a politician, Rep. Stan Saylor, R-Windsor, said he has never seen anything like what happened in Harrisburg Wednesday.



In a standing-room-only committee hearing, state House Republicans voted to remove one Democrat from every House committee and overturned amendment procedures passed as a reform change in the wake of the 2005 pay raise law.



But it wasn't the vote that got the most attention. Instead, when the Republican committee chairman began a vote on the measure while Democrats wanted to continue debate, Democratic members screamed about dictatorship and slavery before storming out of the room.



The proposal now goes to the full House, where Republicans hold a 112-91 seat majority.



Democrats were upset because they said House Majority Leader Mike Turzai stifled debate from Democratic members who said the changes would disenfranchise their constituents.



But Saylor said Democrats were wrong to act in the way they did because Republicans have done a good job being bipartisan.



"(Republicans) have negotiated with them since the day we took over," Saylor said. "Everything we've been talking about, we have worked with them on the committee side, we worked with them on a lot of things."



Civility: Wednesday's event came just one day after President Barack Obama began his State of the Union address with a call for civility. And just last week, Gov. Tom Corbett's inaugural address challenged state lawmakers to be firmly dedicated to a civil discourse.



Although Saylor acknowledged that the average citizen might be upset that civility between Republicans and Democrats hasn't been shown so far, he said in the end all that will matter is "what will get accomplished."



"If we allow Democrats to block good reform, they'll say 'Look at us, it's just us bickering and not getting anything done.' And I think people want to see government in action and sometimes that's not pretty. But in a week or two from now when reforms start getting passed, people will start paying attention," he said.



Reaction: Rep. Eugene DePasquale, D-York City, said he is very frustrated with Wednesday's events.



"I view it as an overreaction. Hopefully we can get back together and make things work. Because we certainly need to work together," DePasquale said.



"You get a little ticked that amendments happen sometimes. But if every time you have a situation where you drive out one side from sharing their views, you get bad legislation. I just think at the end of the day, legislators have to be able to offer amendments if they think they can improve the bill."



No comment: During Wednesday's commotion, Saylor sat to the left of Turzai and remained silent. He said even though he is the House majority whip - which is the third highest Republican job in the House, behind speaker of the House and majority leader - there was "no use" for him to say anything.



"Why would I want to shout back at the Democrats? It would not have done me any good. When a chairman strikes the gavel to quiet everyone, you be quiet," he said.



Going forward, the proposed changes from Wednesday will likely be voted on by the full House Monday.



And by that time, Saylor said he is planning to meet with some Democrats "to make sure something like Wednesday's events don't happen again."

Controversial Muslim cleric caught being smuggled into U.S. over Mexico border

U.S. border guards got a surprise when they searched a Mexican BMW and found a hardline Muslim cleric – banned from France and Canada – curled up in the boot.



Said Jaziri, who called for the death of a Danish cartoonist that drew pictures of the prophet Mohammed, was being smuggled into California when he was arrested, along with his driver Kenneth Robert Lawler.



The 43-year-old was deported from Canada to his homeland Tunisia in 2007 after it emerged he had lied on his refugee application about having served jail time in France.
