Court: No right to resist illegal cop entry into home

INDIANAPOLIS | Overturning a common law dating back to the
English Magna Carta of 1215, the Indiana Supreme Court ruled
Thursday that Hoosiers have no right to resist unlawful police
entry into their homes.

In a 3-2 decision, Justice Steven David writing for the court
said if a police officer wants to enter a home for any reason or no
reason at all, a homeowner cannot do anything to block the
officer's entry.

"We believe ... a right to resist an unlawful police entry into
a home is against public policy and is incompatible with modern
Fourth Amendment jurisprudence," David said. "We also find that
allowing resistance unnecessarily escalates the level of violence
and therefore the risk of injuries to all parties involved without
preventing the arrest."

David said a person arrested following an unlawful entry by
police still can be released on bail and has plenty of
opportunities to protest the illegal entry through the court
system. 

The court's decision stems from a Vanderburgh County case in
which police were called to investigate a husband and wife arguing
outside their apartment.

When the couple went back inside their apartment, the husband
told police they were not needed and blocked the doorway so they
could not enter. When an officer entered anyway, the husband shoved
the officer against a wall. A second officer then used a stun gun
on the husband and arrested him.

Professor Ivan Bodensteiner, of Valparaiso University School of
Law, said the court's decision is consistent with the idea of
preventing violence.

"It's not surprising that they would say there's no right to
beat the hell out of the officer," Bodensteiner said. "(The court
is saying) we would rather opt on the side of saying if the police
act wrongfully in entering your house your remedy is under law, to
bring a civil action against the officer."

Justice Robert Rucker, a Gary native, and Justice Brent Dickson,
a Hobart native, dissented from the ruling, saying the court's
decision runs afoul of the Fourth Amendment of the U.S.
Constitution.

"In my view the majority sweeps with far too broad a brush by
essentially telling Indiana citizens that government agents may now
enter their homes illegally -- that is, without the necessity of a
warrant, consent or exigent circumstances," Rucker said. "I
disagree."

Rucker and Dickson suggested if the court had limited its
permission for police entry to domestic violence situations they
would have supported the ruling.

But Dickson said, "The wholesale abrogation of the historic
right of a person to reasonably resist unlawful police entry into
his dwelling is unwarranted and unnecessarily broad."

This is the second major Indiana Supreme Court ruling this
week involving police entry into a home.

On Tuesday, the court said police serving a warrant may enter a
home without knocking if officers decide circumstances justify
it. Prior to that ruling, police serving a warrant would have to
obtain a judge's permission to enter without knocking.

“Flyer say Free Mumia on my freezer,” he raps in another song. Mumia Abu-Jamal is a prison inmate and former member of the Black Panther Party who was convicted in 1981 for killing a Philadelphia police officer.

Common even named his daughter after Assata Shakur, a Black Panther who was convicted of first-degree murder 1977 and escaped from prison and exiled to Cuba, with the FBI recognizing her as a domestic terrorist.

Common wrote this tribute to Shakur, who was charged with murder, attempted murder, armed robbery, bank robbery, and kidnapping, after going to Havana to meet her personally:

Common’s song about Assata Shakur, formerly known as Joanne Chesimard, who was convicted for the 1973 slaying of Trooper Werner Foerster on the New Jersey Turnpike, has aroused the ire of Garden State police for “A Song for Assata,” which includes the lines “Your power and pride is beautiful. May God bless your soul.”

David Jones, president of the State Troopers Fraternal Association union, said that “the young people who read this stuff, hear this stuff, are getting a very dangerous and deadly message.”

He shouldn’t be let into the White House,” Former New Jersey state trooper Sal Maggio said, “I don’t think any time is right for a man like this who proposes violence toward police.”

Though Washington Post Company chairman Donald Graham told shareholders Thursday morning he was unaware of the Common rapper controversy, the Obama’s surely were aware that it is National Police Week, which is observed every year to honor fallen police officers. Obama didn’t go in 2009 either, instead choosing to host the World Series winners, where he offered condolences to a Philadelphia Phillie who lost his mother during the playoffs: “I know how tough that is. Fraternal Order of Police National President Chuck Canterbury sent a letter conveying his “profound disappointment” with the Common invitation – even following it up with a phone call informing Obama’s staff that National Police Week is “a time to honor law-enforcement officers for their service and sacrifice.”

This is the same Common who rapped at the 2008 New Year celebration at Wright’s church. “I’m gonna let you know, No people want drama, We gonna vote for my man, What’s his name? Obama … Revolution is here,” he sang, while Radical Rev. Wright danced in the background.

Here is a 2005 interview in which Common explains that White women are find for casual sex, but not to have meaningful relationships with:

Americans, when rapper Jay-Z came to the White House, he was granted an “unscheduled” visit with President Obama and even sat in the chair of the Commander in Chief under the Presidential Seal in the Situation Room.  When America chose to elect the totally corrupt Barrack Hussein Obama, Obama told us beforehand to judge him on the people he associates with. This is a clear line in the sand for Americans to consider: Common’s America consisting of hatred for interracial marriage, hatred for cops along with the Law and Order (remember ‘No Snitch’ emboldens criminal and criminal activity) that goes along with Civil Society, while uplifting cop-killers, calling for the death of political leaders, and emboldening the racist Black Panther group, or an America that is the opposite of those values.

Fukushima Daiichi plant worker dies

A worker at the Fukushima Daiichi nuclear power plant fell unconscious at work on Saturday and later died.



The worker in his 60s complained of ill health while working at a waste processing facility. He worked for a subcontracting firm of Tokyo Electric Power Company.



The man was taken to a medical office in the plant, where he was found to have lost consciousness. He was then taken by ambulance to a hospital in Iwaki City and confirmed dead shortly after 9:30 AM. The cause of his death is unknown.



Tokyo Electric says the worker had been transporting equipment since Friday. He was scheduled to work for 3 hours from 6:00 AM on Saturday.



The company says the worker had put on a full protective suit and was not exposed to radioactive substances.



This was the first time that a worker at the Daiichi plant died after the March 11th disaster.

A British woman has been beheaded in front of horrified tourists in a supermarket on the Spanish holiday island of Tenerife.















The woman, who was described as being in her 60s, was in shop in the town of Arona, about 10 miles from the popular beach resort of Los Christianos, when she was brutally stabbed to and then decapitated.






According to witnesses, the attacker, who is thought to be a homeless man of Bulgarian origin, entered the store, grabbed a knife and launched a frenzied and unprovoked attack on the woman.






He then decapitated her before leaving the store carrying her head.






Holidaymakers and locals on the Spanish island described their complete shock and horror after witnessing the scene, which took place at around 10.30am local time (9.30am GMT) on Friday.






British journalist Colin Kirby, 50, who lives in Tenerife, was walking past the store when he saw the attacker emerging.






He said he saw the man walking away carrying what he thought was a joke head and only realised the true horror of what he was witnessing when members of the public and security officers apprehended the man.



Mr Kirby said: “It looked like he was carrying a prop from the Clash of the Titans but then I realised it wasn’t a joke.



“He went to walk across the road and then some security spotted him and managed to grapple him to the ground. They had to fight off some of the locals who were trying to get to him.”



Christina Perez, a legal representative at a nearby court, said a group of lawyers witnessed the man sprinting out of the store, carrying the head.



“They saw the man running out of the supermarket with the head in his hands.



"A security man from the complex ran after him and jumped on to him so he fell, and then he threw the head on to the road," she said.



Ms Perez, 38, added that her frightened colleagues darted indoors for safety.



“They were shocked. Some of them ran to the office and locked themselves in,” she said.



“Everybody is shocked. It's a very safe area. You can usually go anywhere you want in the day or at night. This is really not normal.”



Another witness described seeing the attacker drop the woman’s head to the pavement before he was detained by security officers and police.



The woman said: “I saw a man running out with someone in his hands and a security guard chasing him. He threw it to the ground, it almost hit me, and what he had been carrying was a woman’s head.”



The attack took place as scores of holiday makers browsed among the souvenir stores in the bustling shopping district of Arona.



Some of those who witnessed the attack had to be treated for shock as the true horror of what they had seen began to sink in.



There were reports that the weapon used was a knife taken from the store where the attack took place, but other witnesses claimed the man had been carrying a machete when he entered the shop.

SAS corporal facing child rape charges unmasked by court


An SAS corporal will stand trial accused of child sex offences - including 12
rape charges, according to reports.


Corporal Ian Tuckley has been named after an injunction protecting his
identity was lifted.



Some of his alleged victims were as young as six, The Sun newspaper claimed.
He was arrested last year.



Tuckley, 31, believed to be a specialist dog handler, served with the SAS for
more than five years in Afghanistan as well as in Britain.



He faces 31 charges over alleged assaults against young girls between July
1997 and July 2010.



Tuckley and his co-defendant Martin Finney, 40, are on remand in prison and
will be tried at Worcester Crown Court.


Finney faces 24 charges of rape, assault and sexual assault. The former St
John Ambulance paramedic is accused of drugging one woman with nitrous
oxide, which is usually used for women in labour.


It is understood that the Director of Special Forces applied for the reporting
ban to provide anonymity to Tuckley.
