Texas Resident Arrested on Charge of Attempted Use of Weapon of Mass Destruction

Suspect Allegedly Purchased Bomb Materials and Researched U.S. Targets


WASHINGTON—Khalid Ali-M Aldawsari, 20, a citizen of Saudi Arabia and resident of Lubbock, Texas, was arrested late yesterday by FBI agents in Texas on a federal charge of attempted use of a weapon of mass destruction in connection with his alleged purchase of chemicals and equipment necessary to make an improvised explosive device (IED) and his research of potential U.S. targets.


The arrest and the criminal complaint, which was unsealed in the Northern District of Texas, were announced by David Kris, Assistant Attorney General for National Security; James T. Jacks, U.S. Attorney for the Northern District of Texas; and Robert E. Casey Jr., Special Agent in Charge of the FBI Dallas Field Division.


Aldawsari is expected to make his initial appearance in federal court in Lubbock at 9:00 a.m. on Friday morning. Aldawsari, who was lawfully admitted into the United States in 2008 on a student visa and is enrolled at South Plains College near Lubbock, faces a maximum sentence of life in prison and a $250,000 fine if convicted of attempted use of a weapon of mass destruction.


According to the affidavit filed in support of the complaint, Aldawsari has been researching online how to construct an IED using several chemicals as ingredients. He has also acquired or taken a substantial step toward acquiring most of the ingredients and equipment necessary to construct an IED and he has conducted online research of several potential U.S. targets, the affidavit alleges. In addition, he has allegedly described his desire for violent jihad and martyrdom in blog postings and a personal journal.


"As alleged in the complaint, Aldawsari purchased ingredients to construct an explosive device and was actively researching potential targets in the United States. Thanks to the efforts of many agents, analysts, and prosecutors, this plot was thwarted before it could advance further," said Assistant Attorney General Kris. "This case serves as another reminder of the need for continued vigilance both at home and abroad."


"Yesterday's arrest demonstrates the need for and the importance of vigilance and the willingness of private individuals and companies to ask questions and contact the authorities when confronted with suspicious activities. Based upon reports from the public, Aldawsari's plot was uncovered and thwarted. We're confident we have neutralized the alleged threat posed by this defendant. Those reports resulted in the initiation of a complex and far-reaching investigation requiring almost around the clock work by hundreds of dedicated FBI agents, analysts, prosecutors, and others. Their effort is another example of the work being done to protect our country and its citizens. These individuals are deserving of our respect and gratitude," said U.S. Attorney Jacks.

Purchases of Chemical Ingredients and Other Equipment


The affidavit alleges that on Feb. 1, 2011, a chemical supplier reported to the FBI a suspicious attempted purchase of concentrated phenol by a man identifying himself as Khalid Aldawsari. According to the affidavit, phenol is a toxic chemical with legitimate uses, but can also be used to make the explosive trinitrophenol, also known as T.N.P., or picric acid. The affidavit alleges that other ingredients typically used with phenol to make picric acid, or T.N.P., are concentrated sulfuric and nitric acids.


Aldawsari allegedly attempted to have the phenol order shipped to a freight company so it could be held for him there, but the freight company returned the order to the supplier and called the police. Later, Aldawsari falsely told the supplier he was associated with a university and wanted the phenol for "off-campus, personal research." Frustrated by questions being asked over his phenol order, Aldawsari cancelled his order and later e-mailed himself instructions for producing phenol. The affidavit alleges that in December 2010, he successfully purchased concentrated nitric and sulfuric acids.


According to the affidavit, legally authorized electronic surveillance revealed that Aldawsari used various e-mail accounts in researching explosives and targets, and often sent e-mails to himself as part of this process. On Feb. 11, 2011, for instance, he allegedly e-mailed himself a recipe for picric acid, which the e-mail describes as a "military explosive." He also allegedly sent himself an e-mail on Oct. 19, 2010 that contained information on the material required for Nitro Urea, how to prepare it, and the advantages of using it.


The affidavit alleges that Aldawsari also e-mailed himself instructions on how to convert a cellular phone into a remote detonator and how to prepare a booby-trapped vehicle using items available in every home. One e-mail allegedly contained a message stating that "one operation in the land of the infidels is equal to ten operations against occupying forces in the land of the Muslims." During December 2010 and January 2011, Aldawsari allegedly purchased many other items, including a gas mask, a Hazmat suit, a soldering iron kit, glass beakers and flasks, wiring, a stun gun, clocks, and a battery tester.


Searches of Aldawsari's Residence


Two legally authorized searches of Aldawsari's apartment conducted by the FBI in February 2011 indicated that the concentrated sulfuric and nitric acids; the beakers and flasks; wiring; Hazmat suit; and clocks were present in Aldawsari's residence.


FBI agents also found a notebook at Aldawsari's residence that appeared to be a diary or journal. According to the affidavit, excerpts from the journal indicate that Aldawsari had been planning to commit a terrorist attack in the United States for years. One entry describes how Aldawsari sought and obtained a particular scholarship because it allowed him to come directly to the United State and helped him financially, which he said "will help tremendously in providing me with the support I need for Jihad." The entry continues: "And now, after mastering the English language, learning how to build explosives and continuous planning to target the infidel Americans, it is time for Jihad."


In another entry, Aldawsari allegedly wrote that he was near to reaching his goal and near to getting weapons to use against infidels and their helpers. He also listed a "synopsis of important steps" that included obtaining a forged U.S. birth certificate; renting a car; using different driver's licenses for each car rented; putting bombs in cars and taking them to different places during rush hour; and leaving the city for a safe place.


Research on Potential Targets


According to the affidavit, Aldawsari conducted research on various targets and e-mailed himself information on these locations and people. One of the documents he sent himself, with the subject line listed as "Targets," allegedly contained the names and home addresses of three American citizens who had previously served in the U.S. military and had been stationed for a time at Abu Ghraib prison in Iraq.


In another e-mail titled "NICE TARGETS 01," Aldawsari allegedly sent himself the names of 12 reservoir dams in Colorado and California. In another e-mail to himself, titled "NICE TARGETS," he listed two categories of targets: hydroelectric dams and nuclear power plants. On Feb. 6, 2011, the affidavit alleges, Aldawsari sent himself an e-mail titled "Tyrant's House," in which he listed the Dallas address for former President George W. Bush. The affidavit also alleges that Aldawsari conducted research that could indicate his consideration of the use of infant dolls to conceal explosives and possible targeting of a nightclub with an explosive concealed in a backpack.


The affidavit also alleges that Aldawsari created a blog in which he posted extremist messages. In one posting, he expressed dissatisfaction with current conditions of Muslims and vowed jihad and martyrdom. "You who created mankind….grant me martyrdom for Your sake and make jihad easy for me only in Your path," he wrote.


This case was investigated by the FBI's Dallas Joint Terrorism Task Force, with assistance from the Lubbock Police Department. The prosecution is being handled by Assistant U.S. Attorneys Richard Baker and Denise Williams from the U.S. Attorney's Office for the Northern District of Texas, and Trial Attorney David Cora from the Counterterrorism Section of the Justice Department's National Security Division.


The charges contained in the criminal complaint are merely allegations, and the defendant is presumed innocent unless and until proven guilty.

GAZA CITY: Israeli jets bombed several sites in the Gaza Strip early Thursday in response to a rocket attack on a southern Israeli city, the military said.

There were no immediate reports of casualties in the air force strikes or from the rocket that landed in the city of Beersheba, the first time the city has been targeted since Israel’s devastating 2009 Gaza offensive.

The tit-for-tat fire comes after a day of clashes along the Gaza border in which one Islamic Jihad militant was killed and 10 other people wounded.

The military said in a statement it had “targeted a terrorist squad in the northern Gaza Strip, in the same location where rockets were fired towards the Israeli city of Beersheva.”

Later, war planes bombed several other sites across the coastal strip, which the military called “hubs of terror.” It gave no further details.

Israeli television broadcast footage of a crater gouged out of a street next to a badly damaged house that was hit by a military grade Grad rocket. Read more…

In a 6-2 decision, the Supreme Court voted to protect pharmaceutical companies from liability when their vaccines cause debilitating injuries and death. The high court majority considers vaccines “unavoidably unsafe” and was worried about drug makers being sued and obligated to compensate their vaccine victims. Instead of opting to protect children, the Supreme Court chose to safeguard the financial interests of the multi-billion dollar vaccine industry.

The ruling was a defeat for Hannah Bruesewitz, who suffered from a severe brain injury, developmental delays, and a lifelong seizure disorder after receiving a mandated DPT vaccine. She was denied compensation by the U.S. Court of Claims, which administers the federal Vaccine Injury Compensation Program. Established by Congress in 1986, this program was designed as a non-adversarial way for vaccine victims to be compensated for their injuries caused by compulsory vaccinations. However, during the past several years, this “non-adversarial” program has degenerated into a hostile and expensive legal battle for parents seeking restitution for their losses; nearly 4 out of every 5 cases are rejected.

After being rejected by the U.S. Court of Claims (following several years of adversarial litigation), Hannah’s attorneys sued in civil court, providing evidence that the DPT vaccine manufacturer, Wyeth-Lederle, had the technology to produce a less reactive, purified pertussis vaccine but declined to do so. However, the Supreme Court has now declared that justice cannot be sought in American courtrooms.

According to Barbara Loe Fisher of the National Vaccine Information Center, “This is a sad day for all Americans forced by law to use dozens of doses of vaccines or be barred from school or health insurance or employment. The only leverage left to American consumers to ensure that vaccines with the fewest health risks are produced is to oppose vaccine mandates and work to defend vaccine exemptions in all public health laws.” Read more…

Federal officials on Thursday announced the arrest of a Saudi citizen who was attending a community college in Texas while allegedly plotting to conduct a bombing campaign within the United States.

Khalid Ali-M Aldawsari, 20, of Lubbock, Texas, was arrested by agents of the Federal Bureau of Investigation after an intense ’round-the-clock investigation uncovered ongoing efforts to obtain and mix explosive chemicals and to identify potential targets, officials say.

Agents found an e-mail file entitled “Tyrant’s House” containing the Dallas address of former President George W. Bush. Other files included information about hydroelectric dams, nuclear power plants, and the names and addresses of three individuals previously stationed with the US military at Abu Ghraib prison in Iraq.

The full extent of the damage caused by the BP oil disaster last April may not become apparent for at least another decade, says Samantha Joye, a professor in the Department of Marine Sciences at the University of Georgia. Contrary to claims made by BP’s compensation fund that the Gulf will fully recover by 2012, Joye says that 2012 will more than likely mark the point at which some of the more serious Gulf damage begins to come to light.

Under healthy conditions, multitudes of organisms and microorganisms populate the Gulf seafloor and provide oxygenation for sediment and food for other species. These creatures, which play a vital role in the aquatic food chain, were largely devastated by the oil disaster, though the issue has not been addressed. In time, this hidden devastation throughout the entire aquatic ecosystem will become apparent, and the end result will not be pretty.

“Filter-feeding organisms, invertebrate worms, corals, sea fans — all of those were substantially impacted — and by impacted, I mean essentially killed,” said Joye, concerning the damage. “Another critical point is that detrital feeders like sea cucumbers, brittle stars that wander around the bottom, I didn’t see a living (sea cucumber) around on any of the wellhead dives. They’re typically everywhere, and we saw none.”

The long-term effects of the absence of these creatures will be a loss of the many other creatures that live near the surface, which include many varieties of fish and other sea creatures that humans use for food. If these creatures ultimately die due to a major break in the food chain, fisheries around the Gulf will no longer be able to operate, and many species of Gulf fish could cease to exist.

“I do believe that (the Gulf) will recover from this insult, but I don’t think it’s going to recover fully by 2012,” added Joye. “I think it’s going to be 2012 before we begin to really see the fisheries [sic] implications and repercussions from this.”

Associated Press logo smallPHOENIX – A Phoenix jury convicted an Iraqi Muslim immigrant of second-degree murder Tuesday for running over and killing his daughter in a case termed an "honor killing" by prosecutors who said the father carried out the attack because he believed his daughter had become too Westernized.

Associated Press video buttonFaleh Hassan Almaleki, 50, also was convicted of aggravated assault for injuries suffered by the mother of his daughter's boyfriend during the October 2009 incident in a suburban Phoenix parking lot, as well as two counts of leaving the scene of an accident.

Maricopa County prosecutors told jurors during the trial that he mowed down Noor Almaleki, 20, with his Jeep Cherokee because he believed she brought dishonor to the family. He had wanted her to be a traditional Iraq woman, while she refused an arranged marriage, went to college and had a boyfriend.

The case brought nationwide outrage after prosecutors deemed it an "honor killing."

Defense lawyers called Noor's death and the severe injuries to Amal Khalaf an accident. They said he only wanted to spit on the older woman, who Almaleki thought helped his daughter stay away from her family. Khalaf had taken Noor in several times after she left home between 2007 and 2009, and that was a cause of increasing friction between the families.

A detective testified that Almaleki acknowledged under questioning by police that he intentionally ran her over. But the transcript of the taped interview showed he repeatedly called the incident an accident. Khalaf also testified during the four-week trial, saying he ignored her screams to stop before he struck her and then ran down Noor.

The defense called no witnesses. They argued for a lesser charge, saying Almaleki made a split-second decision that he should be held accountable for but that he did not intend to kill anyone.

His lawyer said during opening statements that the truck driver from southern Iraq was angry at the older woman, and he was trying to drive by and spit on her when she jumped in front of his Jeep.

He swerved, but could not avoid accidentally hitting her and running over his daughter, his lawyer said.

Almaleki, who wore headphones as he listened to an interpreter, showed little emotion when the jury read the verdict.

The court was scheduled to convene Wednesday to hear testimony from Khalaf on the aggravated assault conviction. She remained composed Tuesday as the verdict was read and declined reporters' request for comment, as did prosecutors.

Defense attorneys said in a written statement that they were "pleased the jury took the time necessary to consider all of the evidence in this important case," but declined further comment.

The incident happened on Oct. 20, 2009, outside a state Department of Economic Security office in the west Phoenix suburb of Peoria. Noor had gone with Khalaf to interpret and the women were waiting to be helped when Faleh Almaleki came into the office.

He left after a short time, and Khalaf said she was worried he might do something violent toward Noor, so she drove around the parking lot to make sure he had left. She testified that she was so nervous, she locked her keys in her van and had to call her son to bring another set.

They left the office to go to a nearby restaurant when the Jeep bore down on the women.

Almaleki fled to Mexico and then London, where he was detained and then returned to the U.S.

As part of Operation Fallen Hero-Operation Bombardier, Houston-area federal, state, and local law enforcement officials have joined forces in a series of coordinated strikes against Mexican drug cartels and their associates who operate across the United States. Operations in Central America, Colombia, and Brazil are also ongoing. Law enforcement counterparts have mobilized to increase pressure on these organizations at every level.

This series of operations illustrate the continued resolve and commitment to attack these brutal Mexican cartels and trafficking associates with a unified front. These efforts have proven successful as illustrated by seizures today in the Houston area of approximately $750,000 in U.S. currency, 322 pounds of marijuana, 13 kilograms of cocaine, 37 weapons, 10 vehicles, and the arrest of 33 individuals.

KANSAS CITY, MO—Beth Phillips, United States Attorney for the Western District of Missouri, announced that a Springfield, Missouri man pleaded guilty in federal court today to his role in a sex trafficking conspiracy in which a young, mentally deficient woman was coerced into being a sex slave for several years while she was tortured in a trailer home located in a wooded area in Lebanon, Missouri.

James Noel, 45, of Springfield, pleaded guilty before U.S. District Judge Dean Whipple to the charge contained in a Sept. 7, 2010, federal indictment.

Noel admitted that he was one of the customers who sexually abused and tortured the female victim, who is identified as “FV.” Noel watched the victim being tortured and sometimes operated torture devices himself beginning in 2006, when she was approximately 20 years old. Noel knew that FV hated being electrocuted with a crank phone, which was one of the torture devices used to electrocute her, but he used it on her anyway.

Noel described the crank phone and another electrical device that was used to torture FV as “extremely painful.” Noel electrocuted FV with the crank phone himself and sometimes two men tortured FV with crank phones at the same time. These devices were wired inside FV’s vaginal and anal openings and to her toes. Noel admitted that he paid $300 for a special “show” that lasted two or three hours and included these sex acts.

According to today’s plea agreement, Noel described FV as mentally delayed for her age. He believed she lacked the ability to communicate normally and had a limited vocabulary. Noel admitted that FV did not have any ability to offer an opinion or refuse to follow orders.

Under federal statutes, Noel is subject to a sentence of up to five years in federal prison without parole, plus a fine up to $250,000 and an order of restitution. A sentencing hearing will be scheduled after the completion of a presentence investigation by the United States Probation Office.

This case is being prosecuted by Assistant U.S. Attorneys Cynthia L. Cordes and John Cowles. It was investigated by the Federal Bureau of Investigation in conjunction with the Human Trafficking Rescue Project.

Ocean City Man Indicted for Possessing Child Pornography

BALTIMORE—A federal grand jury has indicted Lawrence Franklin King III, age 41, of Ocean City, Maryland, for possession of child pornography. The indictment was returned on December 7, 2010. King had his initial appearance in U.S. District Court in Baltimore on Friday, February 18, 2011, after related state charges were dismissed. King had a detention hearing late yesterday in U.S. District Court in Baltimore, and U.S. Magistrate Judge Mildred Methvin ordered that he be detained pending trial.

The indictment was announced by United States Attorney for the District of Maryland Rod J. Rosenstein; Special Agent in Charge Richard A. McFeely of the Federal Bureau of Investigation; Anne Arundel County Police Chief James Teare, Sr.; Colonel Terrence Sheridan, Superintendent of the Maryland State Police; Worcester County Sheriff Reggie T. Mason, Sr.; and Worcester County State’s Attorney Beau Oglesby.

“Our community demands that these types of offenders be held completely accountable for their actions, and we know that our cooperation with federal prosecutors in this matter will help achieve this goal,” said Beau Oglesby, State’s Attorney for Worcester County.

According to the indictment, on October 10, 2010, King allegedly possessed at least four images and a video documenting the sexual abuse of a minor. The indictment also seeks the forfeiture of the computer from which the images were recovered, as well as any property used to commit the offense.

King faces a minimum of 10 years in prison and a maximum sentence of 20 years in prison for possession of child pornography. King remains detained on related state charges.

An indictment is not a finding of guilt. An individual charged by indictment is presumed innocent unless and until proven guilty at some later criminal proceedings.

This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse launched in May 2006 by the Department of Justice. Led by United States Attorneys’ Offices and the Criminal Division's Child Exploitation and Obscenity Section (CEOS), Project Safe Childhood marshals federal, state, and local resources to better locate, apprehend, and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims. Virginia Man Sentenced to 25 Years in Prison for Providing Material Support and Encouraging Violent Jihadists to Kill U.S. Citizens

WASHINGTON—Zachary Adam Chesser, 21, of Fairfax County, Virginia, was sentenced today to 25 years in prison, followed by three years of supervised release, for communicating threats against the writers of the South Park television show, soliciting violent jihadists to desensitize law enforcement, and attempting to provide material support to al Shabaab, a designated foreign terrorist organization.

The sentencing was announced by David Kris, Assistant Attorney General for the National Security Division; Neil H. MacBride, U.S. Attorney for the Eastern District of Virginia; and James W. McJunkin, Assistant Director in Charge of the FBI Washington Field Office.

"Zachary Chesser attempted to provide material support to a foreign terrorist organization and used the Internet to incite violence," said Assistant Attorney General Kris. "Today he is being held accountable for his actions. I applaud the many agents, prosecutors, and analysts who worked tirelessly to bring this man to justice."

"Zachary Chesser will spend 25 years in prison for advocating the murder of U.S. citizens for engaging in free speech about his religion," said U.S. Attorney MacBride. "His actions caused people throughout the country to fear speaking out—even in jest—to avoid being labeled as enemies who deserved to be killed. The fact that a young man from Northern Virginia could support such violence and terror is a sobering reminder of the serious threat that homegrown jihadists pose to this country."

"Zachary Chesser encouraged violent jihad," said James W. McJunkin, Assistant Director in Charge of the FBI's Washington Field Office. "The FBI is concerned about U.S. citizens traveling overseas to join al Shabaab, and we are vigilant in working to disrupt potential plots where U.S. citizens become further indoctrinated and return with actual terrorism experience and training."

According to court documents filed with his plea agreement on Oct. 20, 2010, Chesser maintained several online profiles dedicated to extremist jihad propaganda. Chesser admitted to taking repeated steps in April 2010 to encourage violent jihadists to attack the writers of South Park for an episode that included Muhammad in a bear suit, including highlighting their residence and urging online readers to "pay them a visit." Among the steps he took was posting on multiple occasions speeches by Anwar Al-Awlaki, which explained the Islamic justification for killing those who insult or defame Muhammad. Al-Awlaki was designated by the United States as a "Specially Designated Global Terrorist" on July 12, 2010.

Chesser also admitted that in May 2010, he posted to a jihadist website the personal contact information of individuals who had joined the "Everybody Draw Muhammad Day" group on Facebook, with the prompting that this is "Just a place to start."

Chesser also pleaded guilty to soliciting others to desensitize law enforcement by placing suspicious-looking but innocent packages in public places. Chesser explained through a posting online that once law enforcement was desensitized, a real explosive could be used. Chesser ended the posting with the words, "Boom! No more kuffar." According to court documents, "kuffar" means unbeliever, or disbeliever.

According to court records, Chesser also admitted that from at least January 2010 through July 2010, he posted numerous messages online that included calls from Al-Awlaki to join violent jihadists and step-by-step actions individuals needed to take to leave for jihad. Among those postings included a video Chesser made that featured images of mujahedeen in Somalia and a song, sung by Chesser, with the translated title, "America We Are Coming."

Chesser admitted that he promoted online what he called "Open Source Jihad," where he would direct jihadists through his online forums to information on the Internet that they could use to elude capture and death while maintaining relevance and striking capability. This included linking to the entire security screening manual used by the Transportation Security Administration and hundreds of books that contained information on the construction of anti-aircraft missiles and tactics, techniques, and weapons for targeting aircraft such as jet airplanes and helicopters.

In addition, Chesser pleaded guilty to attempting to provide material support to al Shabaab. On Feb. 29, 2008, the U.S. Department of State designated al Shabaab as a foreign terrorist organization, describing it as a violent and brutal extremist group based in Somalia with a number of individuals affiliated with al Qaeda. This designation prohibits providing material support or resources to al Shabaab.

According to court records, Chesser admitted that he twice attempted to leave the United States and travel to Somalia for the purpose of joining al Shabaab and engage in violent jihad as a foreign fighter. The first attempt was in November 2009, which was postponed because his wife was unable to obtain her passport. The second attempt was on July 10, 2010, when he sought to board a flight from New York to Uganda with his infant son. He was prevented from boarding the plane, and Chesser admitted that he brought his son with him as part of his "cover" to avoid detection of his intention to join al Shabaab in Somalia. He also attempted to board the plane with a video camera, which he admitted in court that he intended to use to make production quality videos for al Shabaab's propaganda campaign.

Chesser also admitted in court that he posted several online messages in support of al Shabaab, including videos of attacks by al Shabaab on a government building in Mogadishu, a video claiming that African Union troops are responsible for killing civilians in Somalia, a video supporting the merger of al Shabaab with another organization, and links to what Chesser described as the "Al Qaeda Manual" that included instructions in support of violent jihad.

This case is being investigated by the FBI Washington Field Office. Assistant U.S. Attorneys Gordon Kromberg and Thomas H. McQuillan of the U.S. Attorney's Office for the Eastern District of Virginia and Trial Attorney John T. Gibbs of the Counterterrorism Section in the National Security Division are prosecuting the case.

Newark Police Officer and Bank Employee Arrested, Charged
with Conspiring to Commit Bank Fraud for $1.9 Million Loan

NEWARK, NJ—A Newark police officer and a Spencer Savings Bank employee were
arrested this morning for allegedly conspiring to commit bank fraud in order to secure a $1.9
million commercial real estate loan, United States Attorney Paul J. Fishman announced.

Victor Patela, 35, and Jose Dominguez, a/k/a Joseph Dominguez, 44, both of Newark, are
each charged by complaint with one count of conspiracy to commit bank fraud. The defendants
allegedly defrauded Spencer Savings Bank in Elmwood Park, New Jersey for the purpose of securing
the loan.

Patela and Dominguez were arrested this morning in Newark by FBI agents and are
expected to appear before United States Magistrate Judge Michael A. Shipp this afternoon in
Newark federal court.

According to the criminal complaint:

Patela, a Newark police officer and member and owner of JVI Realty, LLC ("JVI"),
applied for a $1.9 million commercial real estate mortgage loan on behalf of JVI with Spencer
Savings Bank, SLA, in an application dated September 14, 2003. Dominguez was an employee
of Spencer Savings and served as the loan officer for JVI Realty's commercial loan.

The bank documented that Patela requested a commercial loan in the amount of
$1,920,000—for the purpose of purchasing apartment buildings owned by Santander Realty
Group in Elizabeth, New Jersey—for $2.4 million. Spencer Savings also provided that the loan amount
constituted 80 percent of the purchase price and that Patela would need to provide the bank with
sufficient evidence of the source of funds for the remaining $480,000. Dominguez recommended
approval of the loan.

As part of the loan documents, Spencer Savings received a Contract for Sale of Real
Estate as evidence of the source of funds. The real estate contract was fraudulent; Patela did not
own the relevant, Newark property in October 2004 at the time that the contract purported it was
sold. Review of the deed for the property revealed that Patela had sold the property more than a
year earlier.

The Mortgage & Security Agreement JVI entered into with Spencer Savings prohibited
Patela from encumbering or mortgaging the Elizabeth apartment buildings without the bank's
written consent. However, JVI Realty, through Patela and Dominguez, subsequently secured a
second mortgage on the Elizabeth apartment buildings—both defendants signing the second
mortgage and mortgage note as corporate officers of JVI. Dominguez never disclosed his
relationship with JVI Realty and Patela to Spencer Savings while serving as the loan officer for
any of the related transactions.

Patela made his last payment on the $1,920,000 mortgage with Spencer Savings in
November 2008, before causing JVI Realty to default on the loan. In February 2010, Patela
turned over the deed to the Elizabeth apartment buildings to Spencer Savings in lieu of
foreclosure. After Spencer Savings sold the Elizabeth buildings, the bank's loss amount totaled
over $400,000.

In March 2009, Patela caused JVI Realty to file for bankruptcy in federal court. As part
of the bankruptcy filing, Patela represented that he took out a second mortgage on the Elizabeth
Properties in November 2004 in the amount of approximately $300,000.

The bank fraud conspiracy charge carries a maximum potential penalty of 30 years in
prison and a maximum fine of $1 million.

U.S. Attorney Fishman credited special agents of the FBI, under the direction of Special
Agent In Charge Michael B. Ward in Newark, with the investigation leading to the charges and
today's arrests.

The government is represented by Assistant U.S. Attorney Zahid N. Quraishi, of the U.S.
Attorney's Office Special Prosecutions Division in Newark.

The charges and allegations in the complaint are merely accusations, and the defendants
are considered innocent unless and until proven guilty.
