Miami Police Shoot, Kill Man Eating Another Man’s Face

Reporting Tiffani Helberg

macarthur_shooting_victimMIAMI (CBSMiami) – Miami police are still tight-lipped about the man they shot and killed on the MacArthur Causeway Saturday afternoon, but new details back claims they had no choice: the naked man they shot was trying to chew the face off another naked man, and refused to obey police orders to stop his grisly meal, which one source now claims included his victim’s nose and eyeballs.
Surveillance video taken from security cameras at the nearby Miami Herald building show a police officer arrive on the scene, appear to be startled by the spectacle of two naked men lying on the street, and draw his service weapon. It appears that the officer shot one of the men, but it was difficult to tell in the video.
The bizarre shooting happened shortly after 2 p.m., when police responded to a 911 call about two naked men fighting on a bike path along the Causeway, which was packed with traffic on a busy holiday weekend.
Miami police have not confirmed the details of what happened next, but sources close to the investigation told CBS4 News that officers found one man gnawing on the face of another, in what one police source called the most gruesome thing he’d ever seen.
The fight was taking place at the causeway exit near the Miami Herald building, and amazed officers tried to stop it, ordering the man making a meal out of the other man to stop.
Armando Aguilar, who heads the local chapter of the Fraternal Order of Police, said he has spoken with the officer who responded. Aguilar said the officer saw what the man was doing, and ordered him to stop. He said the man growled at the officer, and then returned to his meal.
Aguilar said the man ate his victim’s nose and eyeballs.
The officer then used his service weapon and shot the man, Aguilar said, but the gunshot had no effect.
Other sources confirmed that the man refused to obey, and continued his attack. Aguilar said the officer had no choice but to keep shooting until the attacker was dead.
Investigators sharing limited details about the confrontation, saying only that the two men were fighting and the officers felt they had no choice but to take deadly force.
“During this confrontation an officer did discharge his weapon striking one of the individuals, said Det. Willie Moreno, spokesperson for Miami Police.
But the sources close to the investigation say that dry recitation of the facts apparently doesn’t go far enough. They said the man still would not give in to police commands, so officers fired again.
“That individual has lost his life right now,” Moreno said.
With the attacker dead, lying nude on the pavement, officers and paramedics were able to get to his victim and rush him to Jackson Memorial Hospital. Police sources say the man had virtually no face and was unrecognizable.
Police have shared no information about his identity or condition.
The surveillance video supplied to CBS4 by The Herald under a news sharing agreement is disturbing. At one point, whomever was controlling the cameras zoomed in to the two men lying nude and partially obscured by the MetroMover track. One man is motionless, but the other, presumably the man whose face was attacked, can be seen flailing his legs, possibly in pain.
The Herald used video editing tools to obscure portions of that man’s body as he moved.
The video covers a time frame of about 8 minutes, but despite the shooting of the attacker and the obvious distress shown by the victim, paramedics are not seen attempting to rescue him.
The victim was eventually taken to Jackson Memorial Hospital.
Once the bizarre confrontation came to an end, police were left with the task of figuring out what had happened. The investigation forced the closure of the causeway from Miami Beach to Miami, and also closed an exit to the causeway from I-95.
The investigation snarled traffic for hours and delayed thousands of motorists until ways could be found to get them off the causeway.
Police have had little official to say about the details, and have not released the name of the cannibalistic attacker.

Zombie apocalypse becomes reality in Miami as police shoot naked, mindless man literally eating the face off another man

by Mike Adams, the Health Ranger

zombie(NaturalNews) The long-dreaded "zombie apocalypse" may already be underway in Miami, where a human zombie -- a mindless naked man -- was encountered by police officers who found him literally feasting on the face of another naked man. This is a true event and has been reported by CBS Miami

(http://miami.cbslocal.com/2012/05/26/miami-police-confrontation-men-l...) which says:
"Miami police shot and killed a man on the MacArthur Causeway Saturday afternoon, and police sources told CBS4 they had no choice: the naked man they shot was trying to chew the face off another naked man, and refused to obey police orders to stop his grisly meal. ...Officers found one man gnawing on the face of another, in what one police source called the most gruesome thing he’d ever seen."

At that point, the police officers shot the zombie once, but he continued feeding on the other man's face. They were forced to shoot him again, which mercifully killed him. Then they sought to aid the victim whose face was already mostly eaten off.

"With the attacker dead, lying nude on the pavement, officers and paramedics were able to get to his victim and rush him to Jackson Memorial Hospital. Police sources say the man had virtually no face and was unrecognizable. Once the bizarre confrontation came to an end, police were left with the task of figuring out what had happened..."

A surveillance video has surfaced of the incident. Here's a still shot from the video, showing the two men lying on the sidewalk, under a road bridge, with a police car parked nearby:
http://www.naturalnews.com/images/Miami_Zombie_Apocalypse.jpg

The Miami Herald also reported: "According to police sources, a road ranger saw a naked man chewing on another man's face and shouted on his loud speaker for him to back away. When he continued the assault, the officer shot him, police sources said. The attacker failed to stop after being shot, forcing the officer to continue firing. Witnesses said they heard at least a half dozen shots." (http://www.miamiherald.com/2012/05/26/2818832/naked-man-shot-killed-o...)

The Zombie apocalypse begins

Are we now witnessing the rise of the zombies? Humans who subject themselves to fluoride, aspartame, psychiatric drugs, vaccines and street drugs end up lobotomizing their higher brains. Vaccines, for starters, cause extreme neurological damage, and some vaccines are actually made of aggressive viruses designed to "eat" targeted regions of the brain, resulting in a biological lobotomy.

What's left is the primal section of the brain, sometimes called the "reptilian brain." Or the "zombie brain," to use a pop culture term. This zombie brain has no morals and no logic. It only knows hunger, sex, violence and fear. It is entirely focused on selfish needs and has no ability to consider the welfare of others.

"America is becoming a zombie nation," award-winning investigative journalist Jim Marrs recently told me in a phone interview. In fact, he wanted to name his most recent book "Zombie Nation," but the publisher overruled him and instead had it named, "The Trillion Dollar Conspiracy," which doesn't even make that much sense given the broad coverage of topics in the book. The word "zombie" did make it into the subtitle, however. Here's the full title: "The Trillion-Dollar Conspiracy: How the New World Order, Man-Made Diseases, and Zombie Banks Are Destroying America." (http://www.amazon.com/The-Trillion-Dollar-Conspiracy-Man-Made-Destroy...)

Got your zombie ammo yet?

One of my firearms instructors, a former Marine sniper who saw front-line action in Iraq, recently told me, "You know why the zombie apocalypse won't really happen?"

"No, tell me," I replied, because I know he has a sick sense of humor.

"Because I want it to," he grinned.

He's hard core. And he's not alone. Among the community of firearms owners and sports shooters, the idea of an approaching zombie apocalypse is already woven into the culture. So much so that a prominent ammunition manufacturer, Hornady, has even introduced its own line of ammo specifically engineered to blast the brains out of zombies.

It's called "Zombie Max Ammo," and it even has a promotional video that publicizes the superior ballistics of Zombie Max ammo by depicting an actual zombie invasion of society, where firearms-owning citizens fight them off with this special ammo:
http://www.youtube.com/watch?v=bQWb-5nblx4

(Warning: This video is quite graphic, but before you freak out over it, keep in mind this is no worse than mainstream television shows, some of which are written around this very same theme of zombie attacks and which show far worse violence.)

The video follows up with the intriguing text:

"Hornady Zombie Max ammunition is not a toy, but is intended only to be used on... zombies, also known as the living dead, undead, etc."

Read more about Zombie Max ammo at:
http://www.hornady.com/ammunition/zombiemax

You can also buy zombie targets. One website called ZombieAmmo.com sells "zombie targets" that depict humans being taken hostage by zombie creatures:
http://zombieammo.com/zombiepress/zombie_targets/

And if you walk into a gun shop and the salesman shows you the latest wicked .308 AR-10 with a white phosphor night vision scope, a green laser illuminator, and an invisible IR illuminator as a stealth backup target designator, when you ask, "What's all that gear for?" He will smile and tell you, "It's for killin' zombies!"

Some of you who don't visit gun shops actually think I'm trying to be funny and just making this up. The really funny part is that I'm not.

The zombification of America

I suppose that at some deep gut level, most people realize our civilized world is crumbling. The abandonment of law and common sense in the United States (and, heck, the UK too) is just one such sign, but other signs include:

• The increasing number of reports of people who walk right into moving cars and trucks while texting on their mobile devices. This often results in their death. (http://www.telegraph.co.uk/news/worldnews/northamerica/usa/9265401/Da...)

• Increases in bizarre reports of people "sleep driving" as they suddenly awake to find themselves driving around town in their own cars in the middle of the night. (http://www.cbc.ca/news/health/story/2007/04/19/sleep-drug-warning.htm...) From PubMed at the NIH: "Z-drug-impaired drivers may demonstrate cognitive function at low levels with drivers still able to understand and respond to questions while sleepwalkers are completely unable to understand or interact with police. Z-drug-impaired drivers are often severely physically impaired, unable to stand up or maintain balance while sleepwalkers are able to stand and walk unaided." (http://www.ncbi.nlm.nih.gov/pubmed/21367628)

• The complete lack of intelligent questioning about events where the official government explanation makes absolutely no sense: 9/11, the killing of Bin Laden, etc. (http://www.naturalnews.com/033684_911_truth_WTC_7.html)

• The acceleration of flu shot propaganda which now includes pushing flu shots onto pregnant women, too. Flu shots contain chemical adjuvants that lobotomize brain tissue, causing you to be unable to think rationally.

• The rise of a whole new generation of mumbling, neurologically-damaged children who are now routinely seen out in public. Many of these children are, of course, vaccine damaged.

• Aspartame, which "pickles" the brain in formaldehyde, continues to be consumed in ridiculously high quantities through diet sodas. Have you ever noticed that people who drink a lot of diet soda are also the most brain-numbed people around? (www.naturalnews.com/aspartame.html)

• The increase in the sales of products made from human babies. Recently in Korea, a company was busted selling "powdered human baby" in capsules as a longevity pill. And more recently, a UK man was busted in Thailand with six roasted human fetuses in his luggage, wrapped in gold foil. These were being sold as some sort of dark magic power source. Customers apparently eat the fetuses under the belief that doing so will give them power. (http://www.independent.co.uk/news/world/asia/briton-arrested-in-thail...)

• Even the U.S. Centers for Disease Control (CDC) recently warned Americans to prepare for what they call "the coming zombie apocalypse." (http://www.naturalnews.com/032454_zombie_apocalypse_CDC.html) According to a May 16, 2011 announcement by the CDC, "...zombies would take over entire countries, roaming city streets eating anything living that got in their way. CDC would provide technical assistance to cities, states, or international partners dealing with a zombie infestation. This assistance might include consultation, lab testing and analysis, patient management and care, tracking of contacts, and infection control (including isolation and quarantine)."

The CDC's zombie apocalypse page, believe it or not, is still posted at: http://blogs.cdc.gov/publichealthmatters/2011/05/preparedness-101-zom...

• But the No. 1 proof that the zombie apocalypse has already begun is none other than the employee roster of the TSA. Have you ever tried to have a logical conversation with a TSA employee? These people have no functioning higher brain and are hired primarily because they are "primal brain" operatives who enjoy sexually molesting little children. Heck, just recently, a Catholic priest who was thrown out of the church for allegations of sexual abuse of children was found to have been granted a job at the TSA! (http://www.prisonplanet.com/tsa-hired-serial-sex-abuse-priest-pedophi...) (http://www.prisonplanet.com/tsa-outrage-agency-hires-defrocked-priest...)

What would an actual zombie apocalypse look like?

Imagine masses of drooling creatures slinking through the streets in raggedy business suits, oblivious to reality and only seeking to feed on the innocent masses...

Oh wait, that's every day on Wall Street.

But seriously, with each passing day, the U.S. population edges ever closer to true "zombification." And now, we've actually begun to see it taking place on the streets of Miami.

Because when one man LOSES face to another, that's just called politics. But when one man EATS the face of another and won't stop even when he's shot by police, that's zombie land, folks. Lock and load.

Whatcom GOP sees flood of precinct filings from Ron Paul supporters

Grassroots Defined

Each day, I go through stories similar to this one. Some I share, others I don’t. Yet, each demonstrates how Ron Paul supporters are reshaping the Republican Party from the bottom-up. From a story in Washington’s Bellingham Herald titled “Whatcom GOP sees flood of precinct filings from Ron Paul supporters:”

Ron Paul supporters filed en masse to run for Republican Party precinct committee officers, grass-roots elected seats that will be on this year's primary election ballot.

The goal, said one PCO race newcomer, is to return the party to the principles it used to have.
"It needs to change," said Greg Parsons, who is running against PCO Kathy Kershner. "I do have some issues with establishment Republicans. On the contrary, I think we are, in fact, the real, true conservative Republicans."

PCO seats, elected every two years, often receive no interest, or only one person files. This year, because of a flood of interest in Republican PCO seats, many more contested races will be on the ballot.

Republican Party PCOs vote on endorsements and select local party leadership, something the newly elected and re-elected officers will do this December.

Of 152 Republican PCO races, 63 have two or more candidates, according to Whatcom County Auditor's Office data. Only the contested races will appear on the ballot.

In comparison, of the Democratic Party's 60 races, only five are contested.

Whatcom County Auditor Debbie Adelstein said they were surprised to see so many contested Republican races, but the number won't significantly add to election costs.

"The reality is if you have a statewide or a countywide election going on anyway, it doesn't add that much to have that one position," Adelstein said.

Starting this year, Whatcom County is divided into 178 precincts, instead of the old 120. Luanne Van Werven, chairwoman of the Whatcom Republicans, said the party actively recruited people to run. They contacted 150 to 200 people, she said, and recruited 114 candidates.

But nearly an equal number of names unfamiliar to party officials appeared on the filing list, and many challenged longtime PCOs. By comparing them to the list of caucus participants, they learned they are Paul supporters, Van Werven said.

"I suspect that they are interested in organizing - reorganizing - the local Republican Party," Van Werven said.

It's great to have new people get involved - and stay involved - with the party, she said.

"If they are Republicans and committed to Republican principles, it is a good thing," she said. "But if their motive or purpose is anything other than the goals of the Republican Party, then, of course, that's just going to be a net loss for our local party. I'm hopeful that these people are activated for the good of the party."

Barb Del Wraa is running for re-election to her Republican PCO seat in Bellingham. She is a Paul supporter.

She wouldn't call it an attempt to "take over" the party, she said. This election cycle, just like four years ago, brought out many young people with fiscally conservative principles, and they want to get involved in the party.

"It's people who want to become involved, and they want to really start at the base level," Del Wraa said.

She acknowledged a division in the party, with many longtime Republicans believing that Paul supporters aren't true conservatives. Some Paul supporters say they won't support any other nominee for president. While they share 90 percent of Republicans' common principles, she said, there are differences, including in declaring war and with morality issues.

Parsons, of Bellingham, has never run for PCO before. He first learned about the position when he attended the county caucuses at Kulshan Middle School on March 3. He and others are awake, he said, and need to take action. The party establishment is actually "neo-conservatives," and he feels an obligation to return the party to how it used to be, "when we actually believed in civil liberties," Parsons said.

Kershner, his opponent, is facing her third re-election bid as PCO. She's not been challenged before. Kershner is also a County Council member.

"I guess I'd be interested in finding out exactly what their goals are," Kershner said.
She invited he and other Paul supporters at the caucuses to the Republican Party meetings, but they haven't taken her up on the offer, she said.

"I feel like we want to be open to new and young members to the party," she said. "My challenge to them is going to be, are they going to stay involved past this presidential election?"

Vatican in chaos after pope's butler arrested for leaks, bank president ousted

Paolo Gabriele had been Pope's personal butler since 2006

VATICAN CITY — The Vatican’s inquisition into the source of leaked documents has yielded its first target with the arrest of the pope’s butler, but the investigation is continuing into a scandal that has embarrassed the Holy See by revealing evidence of internal power struggles, intrigue and corruption in the highest levels of the Catholic Church governance.
The detention of butler Paolo Gabriele, one of the few members of the papal household, capped one of the most convulsive weeks in recent Vatican history and threw the Holy See into chaos as it enters a critical phase in its efforts to show the world it’s serious about complying with international norms on financial transparency.
The tumult began with the publication last weekend of a book of leaked Vatican documents including correspondence, notes and memos to the pope and his private secretary. It peaked with the inglorious ouster on Thursday of the president of the Vatican bank. And it concluded with confirmation Saturday that Pope Benedict XVI’s own butler was the alleged mole feeding documents to Italian journalists in an apparent bid to discredit the pontiff’s No. 2.

“If you wrote this in fiction you wouldn’t believe it,” said Carl Anderson, a member of the board of the Vatican bank which contributed to the whirlwind with its no-confidence vote in its president, Ettore Gotti Tedeschi. “No editor would let you put it in a novel.”
The bank, known as the Institute for Religious Works, issued a scathing denunciation of Gotti Tedeschi in a memorandum obtained Saturday by The Associated Press. In it the bank, or IOR by its Italian initials, explained its reasons for ousting Gotti Tedeschi: he routinely missed board meetings, failed to do his job, failed to defend the bank, polarized its personnel and displayed “progressively erratic personal behavior.”
Gotti Tedeschi was also accused by the board of leaking documents himself: The IOR memorandum said he “failed to provide any formal explanation for the dissemination of documents last known” to be in his possession.
In an interview with the AP, Anderson said the latter accusation was independent of the broader “Vatileaks” scandal that has rocked the Vatican for months. But he stressed: “It is not an insignificant issue.”
Gotti Tedeschi hasn’t commented publicly about his ouster or the reasons behind it, saying he has too much admiration for the pope to do so. He also hasn’t been arrested, avoiding the fate that befell Gabriele.
The 46-year-old father of three has been in Vatican detention since Wednesday after Vatican investigators discovered Holy See documents in his apartment. The Vatican spokesman, the Rev. Federico Lombardi, said Gabriele had met with his lawyers and that the investigation was taking its course through the Vatican’s judicial system.
Gabriele, the pope’s personal butler since 2006, has often been seen by Benedict’s side in public, riding in the front seat of the pope’s open-air jeep during Wednesday general audiences or shielding the pontiff from the rain. In private, he is a member of the small papal household that also includes the pontiff’s private secretaries and four consecrated women who care for the papal apartment.
Lombardi said Gabriele’s detention marked a sad development for all Vatican staff. “Everyone knows him in the Vatican, and there’s certainly surprise and pain, and great affection for his beloved family,” the spokesman said.
The “Vatileaks” scandal has seriously embarrassed the Vatican at a time when it is trying to show the world financial community that it has turned a page and shed its reputation as a scandal plagued tax haven.
Vatican documents leaked to the media in recent months have undermined that effort, alleging corruption in Vatican finance as well as internal bickering over the Holy See’s efforts to comply with international norms to fight money laundering and terror financing.
The Vatican in July will learn if it has complied with the financial transparency criteria of a Council of Europe committee, Moneyval — a key step in its efforts to get on the so-called “white list” of countries that share financial information to fight tax evasion.
Anderson acknowleged that the events of the last week certainly haven’t cast the Holy See in the best light. And he said the bank’s board appreciated that the ouster of its president just weeks before the expected Moneyval decision could give the committee pause.
“The board considered that concern and decided that all things considered it was best to take the action at this time,” Anderson said. “These steps were taken to increase the IOR’s position vis-a-vis Moneyval.”
The Vatileaks scandal began in January when Italian journalist Gianluigi Nuzzi broadcast letters from the former No. 2 Vatican administrator to the pope in which he begged not to be transferred for having exposed alleged corruption that cost the Holy See millions of euros in higher contract prices. The prelate, Monsignor Carlo Maria Vigano, is now the Vatican’s U.S. ambassador.
Nuzzi, author of “Vatican SpA,” a 2009 volume laying out shady dealings of the Vatican bank based on leaked documents, last weekend published “His Holiness,” which presented a trove of other documents including personal correspondence to the pope and his secretary — many of them painting Benedict’s No. 2, Cardinal Tarcisio Bertone, in a negative light.
Nuzzi has said he was offered the documents by multiple Vatican sources and insisted he didn’t pay a cent € to any of them.
Gabriele was in Vatican custody and unavailable for comment. No known motive has come to light as to why Gabriele, if he is found to be the key mole, might have passed on the documents. Nuzzi declined to comment Saturday on whether Gabriele was among his sources.
Bertone, 77, has been blamed for a series of gaffes and management problems that have plagued Benedict’s papacy and, according to the leaked documents, generated a not inconsiderable amount of ill will directed at him from other Vatican officials.
“For some time and in various parts of the church, criticism even by the faithful has been growing about the lack of coordination and confusion that reign at its center,” Cardinal Paolo Sardi, the former No. 2 official in the Vatican secretariat of state, wrote to the pope in 2009, according to the letter cited in “His Holiness.”
Anderson, who heads the Knights of Columbus, a major U.S. lay Catholic organization, said he was certain the Holy See would weather the storm and that the Vatican bank, at least, could move forward under a new leader with solid banking credentials as well as a desire to show off the bank’s transparency.
“I hope this will be the beginning of a new chapter for the IOR and part of that chapter will be restoring the public image of the IOR,” he told AP. “I think we have a good story to tell.”

Obama May Be In Deep Trouble…with Chief Justice John Roberts, U.S. Supreme Court

According to sources who watch the inner workings of the federal government, a smack-down of Barack Obama by the U.S. Supreme Court may be inevitable.

Ever since Obama assumed the office of President, critics have hammered him on a number of Constitutional issues. Critics have complained that much, if not all of Obama’s major initiatives run headlong into Constitutional roadblocks on the power of the federal government. Obama certainly did not help himself in the eyes of the Court when he used the venue of the State of the Union address early in the year to publicly flog the Court over its ruling that the First Amendment grants the right to various organizations to run political ads during the time of an election. The tongue-lashing clearly did not sit well with the Court, as demonstrated by Justice Sam Alito, who publicly shook his head and stated under his breath, ‘That’s not true,’ when Obama told a flat-out lie concerning the Court’s ruling. As it has turned out, this was a watershed moment in the relationship between the executive and the judicial branches of the federal government. Obama publicly declared war on the court, even as he blatantly continued to propose legislation that flies in the face of every known Constitutional principle upon which this nation has stood for over 200 years.
Obama has even identified Chief Justice John Roberts as his number one enemy, that is, apart from Fox News and Rush Limbaugh, Beck, Hannity, and so on. And it is no accident that the one swing-vote on the court, Justice Anthony Kennedy, stated recently that he has no intention of retiring until ‘Obama is gone.’ Apparently, the Court has had enough. The Roberts Court has signaled, in a very subtle manner, of course, that it intends to address the issues about which Obama critics have been screaming to high heaven. A ruling against Obama on any one of these important issues could potentially cripple the Administration. Such a thing would be long overdue.
First, there is ObamaCare, which violates the Constitutional principle barring the federal government from forcing citizens to purchase something. And no, this is not the same thing as states requiring drivers to purchase car insurance, as some of the intellectually-impaired claim. The Constitution limits FEDERAL government, not state governments, from such things, and further, not everyone has to drive, and thus, a citizen could opt not to purchase car insurance by simply deciding not to drive a vehicle. In the ObamaCare world, however, no citizen can ‘opt out.’
Second, sources state that the Roberts court has quietly accepted information concerning discrepancies in Obama’s history that raise serious questions about his eligibility for the office of President. The charge goes far beyond the birth certificate issue. This information involves possible fraudulent use of a Social Security number in Connecticut, while Obama was a high school student in Hawaii.
And that is only the tip of the iceberg.
Third, several cases involving possible criminal activity, conflicts of interest, and pay-for-play cronyism could potentially land many Administration officials, if not Obama himself, in hot water with the Court. Frankly, nothing comes close to comparing with the rampant corruption of this Administration, not even during the Nixon years. Nixon and the Watergate conspirators look like choirboys compared to the jokers that populate this Administration.
In addition, the Court will eventually be forced to rule on the dreadful decision of the Obama DOJ suing the state of Arizona. That, too, could send the Obama doctrine of open borders to an early grave, given that the Administration refuses to enforce federal law on illegal aliens.
And finally, the biggie that could potentially send the entire house of cards tumbling in a free-fall is the latest revelation concerning the Obama-Holder Department of Justice and its refusal to pursue the New Black Panther Party. The group was caught on tape committing felonies by attempting to intimidate Caucasian voters into staying away from the polls. A whistle-blower who resigned from the DOJ is now charging Holder with the deliberate refusal to pursue cases against Blacks, particularly those who are involved in radical hate-groups, such as the New Black Panthers, who have been caught on tape calling for the murder of white people and their babies. This one is a biggie that could send the entire Administration crumbling–that is, if the Justices have the guts to draw a line in the sand at the Constitution and the Bill of Rights.

HomeTelevision networks are having a busy month trying to stamp out new TV-watching technology, including telling a court that skipping a commercial while watching a recorded show is illegal. Yesterday, Fox, NBC, and CBS all sued Dish Network over its digital video recorder with automatic commercial-skipping. The same networks, plus ABC, Univision, and PBS, are gearing up for a May 30 hearing in their cases against Aereo, a New York startup bringing local broadcast TV to the Internet.  EFF and Public Knowledge filed an amicus brief supporting Aereo this week.
The suits against Dish are a response to the "Hopper" DVR and its "Auto Hop" feature, which automatically skips over commercials. According to the networks' complaints, the Hopper automatically records eight days' worth of prime time programming on the four major networks that subscribers can play back on request. Beginning a few hours after the broadcast, viewers can choose to watch a program sans ads.
These suits are yet another in a long and ignominious series of lawsuits by content owners seeking to control the features of personal electronic devices, and to capture for themselves the value of new technologies no matter who invents them. We've seen this movie before. Most directly, the Dish suits look like a replay of the 2002 suit against DVR maker ReplayTV.  The networks sued ReplayTV for copyright infringement based on another automated commercial-skip feature.  They claimed that viewers were infringing copyright when they skipped ads during playback, that skipping "robs the advertisers," and that ReplayTV should be responsible.  EFF argued then, and in a later suit on behalf of Replay's customers, that choosing not to watch ads during playback is pretty far from being a violation of federal law. Unfortunately, the cost of the suit drove ReplayTV out of business before the court could rule on the networks' wacky theory.
Fast forward ten years.  The networks are accusing Dish of "inducing" copyright infringement. That's a legal theory first created in the record labels' case against peer-to-peer software maker Grokster.  The problem for the networks is that a technology maker, service, or other middleman can't be held liable for inducing copyright infringement unless their customers are actually infringing. And that means the networks will have to convince a judge that people who record a TV show, and later decide to skip over the commercials during playback, are violating federal law.
Dish is fighting back hard, filing its own lawsuit in New York to have its devices ruled legal. Hopefully, the courts won't turn millions of American commercial-skippers into lawbreakers.
