The draft chapter of the Trans-Pacific Partnership (TPP) Agreement on Intellectual Property insists that signatories provide legal incentives for Internet Service Providers (ISPs) to privately enforce copyright protection rules. The TPP wants service providers to undertake the financial and administrative burdens of becoming copyright cops, serving a copyright maximalist agenda while disregarding the consequences for Internet freedom and innovation.

The New York Times Reminds Us the NSA Still Warrantlessly Wiretaps Americans

The New York Times has published two important op-eds highlighting how the National Security Agency (NSA) has retained expansive powers to warrantlessly wiretap Americans after Congress passed the FISA Amendments Act in 2008. And unlike in 2005 -- when the exposure of the NSA's warrantless wiretapping program provoked widespread outrage -- Congress is now all but ignoring ample evidence of wrongdoing, as it debates renewing the FISA Amendments Act before it expires at the end of this year.

Senator Jon Kyl (R-AR) has introduced a new federal anti-SLAPP bill called the Free Speech Act of 2012. While the bill doesn’t go nearly far enough, EFF is encouraged to see that Congress is showing renewed interested in passing legislation to prevent so called "Strategic Lawsuits Against Public Participation" (SLAPP) that attempt to censor and chill First Amendment protected speech.
EFF has sent comments to Victoria Espinel, the Obama Administration's "IP Czar," to help shape how U.S. tax dollars are spent on enforcing copyright, trademark, and patent laws for the next two years.
EFF and Craig Newmark's team at craigconnects have created an infographic about Section 230 of the Communications Decency Act (CDA) of 1996. CDA 230 provides websites, blogs, and social networks that host speech with protection against a range of laws that might otherwise hold them legally responsible for what their users say and do.
Location privacy scored a victory in California when the State Assembly overwhelmingly passed an EFF-sponsored location privacy bill, SB 1434. The bill would require law enforcement to obtain a search warrant anytime it requests location information from an electronic device.

Don’t Let Conspiring Virginia and Federal Officials Hold Themselves Above The Law In Kidnapping And Assaulting Brandon Raub

If Justice Is To Be Served In The Raub Case, Virginia and Federal Officials Involved MUST be Charged With Assault and Kidnapping And if Convicted, Serve Time In Prison For Their Criminal Abuse of Power

On August 16 last, a combined militarized strike force of local, state and federal “law enforcement” personnel (including local and state Virginia police, Homeland Security, FBI and Secret Service agents) kidnapped, assaulted, unlawfully detained and gratuitously committed former marine Brandon J. Raub of Chesterfield Virginia to a psychiatric ward for Facebook postings he had made that were critical of the government.  Mr. Raub was not charged with any crime or wrongdoing beyond a bogus accusation by local police to the press and Raub’s family after his kidnapping that he “assaulted an officer of the law and resisted arrest” although even these spurious charges never were formally filed against Mr. Raub. 

Soon after Raub’s kidnapping, a local Virginia magistrate (a government bureaucrat, not a real judge) refused to release him but still did not charge him with any crime nor did he in anyway justify continuing to hold Raub in custody.  Instead, the magistrate unlawfully ordered Raub to be held in custody over the weekend at a local mental institution for so-called “preliminary evaluation.”  After a hearing on Monday, August 20, a Virginia “special justice”  (also a bureaucrat lawyer, not a real judge) further ordered Raub detained for an additional month, again without charging him with any crime or wrongdoing, and additionally ordered the Virginia captive to be transferred to a Salem Virginia hospital where he was involuntarily committed to another psych ward.

Thankfully, John Whitehead and the Rutherford Institute stepped up to defend Mr. Raub.  The Rutherford Institute is a courageous civil liberties organization that takes on cases like Mr. Raub’s that no one else will touch.  In this video, Mr. Whitehead explains that what happened to Brandon Raub in Virginia is the model for what is spreading all over the country.

Our beloved country is turning into a police state where the government routinely “disappears” people they don't like into a gulag of mental institutions.  John Whitehead sees evidence they are targeting veterans, trying to make former military people look crazy and turning them into scapegoats for the horrible mess of a world they have created.  By "they" I mean the politicians, the bureaucrats, the career military, the corrupt judges and the profiteers inside the military-industrial complex that use our young men and women as cannon fodder and then dispose of them as just so much garbage.

As Whitehead says: “We are moving into a surveillance state.  Anybody the government perceives as a threat can be arrested and put into a mental institution [think old Soviet Union].  They are called ‘Civil Commitments.’ Police arrive at your door; they arrest you; they don't charge you with a crime; they take you to a mental institution”  --  for political statements they don't like  --  20,000 times a year in Virginia alone.

Whitehead described what happened after Raub was kidnapped and the Virginia law-enforcement bureaucrats got him in their clutches:

“. . .the August 20 detention order was 'rubber-stamped' and represents the corrupt system in Virginia...This is the so-called judge – he’s a lawyer, not a real judge – it’s like what you would see in a bad movie.”

After a national outpouring of indignation and outrage over these criminal government actions taken under the color of law, the Virginia government panicked, and on August 23 in a surprise move at what was supposed to be just another “routine” hearing to overrule Raub’s objection to the transfer, another Virginia judge ordered Mr. Raub released on narrow technical grounds.  In his release order, the judge said, “The [government’s] petition is so devoid of any factual allegations that it could not be reasonably expected to give rise to a case or controversy.

Now, we can fully expect to see the Commonwealth of Virginia and federal officials who conspired to kidnap Mr. Raub and violate his constitutional rights mobilize a cover up to make these reprehensible incidents quietly go away.  Don’t let them get away with it.  Don’t let Virginia politicians sweep this under the rug.

Everyone involved in this illegal kidnapping and unwarranted detention must be held to account.  Every official involved in this criminal conspiracy—local, state and federal—must be charged, arrested and tried on charges of kidnapping and assault. Moreover, it was unambiguously clear from the outset that local, state and federal officials at the highest levels criminally conspired to raid Mr. Raub’s house unlawfully, forcibly arrest and detain him without charging him with any crime and then conspired to justify their illegal actions with bogus accusations of resisting arrest and assaulting an officer of the law.  Therefore, all the conspirators and perpetrators of these despicable acts should be charged and tried on racketeering charges under the “Virginia Racketeer Influenced and Corrupt Organization (RICO) Act.”

If justice is to be served, all government officials—local, state and federal—convicted must be brought to justice, under the regular judicial guidelines for sentencing criminals who are convicted of kidnap and assault under the RICO statute.  One can fully expect the government to hold themselves above the law with claims of so-called “sovereign immunity.”  Don’t let them get by with it.  Demand that all the government officials involved in these incidents be held to account under the same laws and under the same terms that apply to ordinary citizens who criminally conspire and then kidnap and assault another person.

This criminal conspiracy between Virginia and federal officials is so outrageous that the ramifications of these unlawful actions go far beyond the harm done to Mr. Raub himself; they undermine the constitutional foundations of the United States of America and the Commonwealth of Virginia.  Therefore, the public is entitled to see all communications among local, state and federal agencies and personnel involved in these unlawful actions taken under the color of law.

Revolution Pac has just begun the fight to stop these kinds of unconscionable criminal actions by our national, state and local governments.  To begin our efforts, we are gathering signatures of concerned citizens like you to this letter, which we will send to the Virginia Attorney General demanding that he take legal action to bring the perpetrators of these crimes to justice.
