Sex-abuse experts weigh claims for archdiocese

Philadelphia -- The cases can be beyond cold, dating back decades.


The wrongful conduct can be as blatant as rape, or as subtle as a whispered compliment.


And the accused are among the most respected men in the region.


To sort it all out, the former sex-crimes prosecutor heading the Archdiocese of Philadelphia's investigation of nearly 30 suspended priests has put together a team that includes experts on the psychology of sex offenders and a pair of ex-police officers from the Special Victims Unit.


Gina Maisto Smith aims to finish her digging in six to nine months.


"These cases at their core are very complex," she said in an interview last week. "They often involve word against word, a delay in reporting, difficult psychological issues on both sides, and allegations typically not supported by physical evidence."


Smith's mandate from the archdiocese is twofold. For nearly two months, she has been reviewing the allegations against priests put on administrative leave after the explosive grand jury report that accused the church of continuing to mishandle cases of clergy sex abuse and other improper behavior with children.


She and her team will make recommendations to Cardinal Justin Rigali on the suspended priests' "suitability for ministry." That choice of phrase is significant; her reports will stop short of declaring the clerics guilty or innocent of misdeeds.


Rigali will then clear them, restore them to ministry with certain restrictions, or defrock them.


Smith's other mission is to guide the hierarchy as it overhauls its process for investigating future complaints. In a major step, the archdiocese last month hired another experienced former Philadelphia prosecutor, Al Toczydlowski, to lead abuse investigations once Smith has dealt with the current pool of suspended clergymen.


Toczydlowski, who has the archdiocesan title "delegate of investigations," will draw upon the same sort of expertise that Smith has at her command.


Smith's new team, paid by the archdiocese as consultants, includes:


Barbara Ziv, a forensic psychiatrist. Ziv, who has made hundreds of assessments of sex offenders for the courts across the region, will play a key role in interviewing accused priests.


Barry Zakireh, a psychologist who specializes in evaluating and treating sex criminals. He heads the sex offenders group at the Joseph J. Peters Institute in Philadelphia.


Maria McColgan, a pediatrician who leads the child-abuse unit at St. Christopher's Hospital for Children. Among other skills, McColgan will provide expertise on child development -- key in weighing the testimony and recollections of those victimized at a young age.


Former Philadelphia Police Officers Thomas McDevitt and Harry Young. Both men, who retired last year, were assigned for more than a dozen years to the Special Victims Unit, where they investigated hundreds of rapes and sexual assaults.


Smith, a member of Philadelphia's Ballard Spahr law firm since 2006, served as an assistant district attorney with the Philadelphia District Attorney's Office for nearly 20 years. She spent most of her career prosecuting sex-crime cases, though she also handled cases of other crimes against children, as well as homicides.


In an interview last week, she noted that societal and legal attitudes toward sexual assault had evolved over the decades, requiring ever-greater sophistication in investigations. When she became a prosecutor in 1988, it was not a crime for a man to rape his wife, and "date rape" absent force was not illegal.


In the cases of the suspended priests, she said, the complaints ranged from outright sexual abuse to "boundary issues."


The church, she said, has to find ways to spot and address the latter transgressions -- conduct that, though short of criminal sexual assault, might include sex talk, massages or back rubs, sharing of pornographic materials, or lavishing gifts on minors.


In its report released Feb. 10, the grand jury lit into the archdiocese for the second time in six years over its handling of predator priests. It also complained that the church had not fully cooperated with the panel's investigation.


Since then, the District Attorney's Office has praised Smith for her willingness to share information.


The grand jury report reflected a follow-up investigation to a 2005 grand jury probe that was also scathing in its criticism of the archdiocese.


Smith and Toczydlowski are operating independently of the law firm Stradley Ronon, which previously oversaw investigations for the archdiocese, according to church officials.


"They're no longer in it," Toczydlowski said of Stradley Ronon. "I have no contact with them."


The grand jury report had criticized the archdiocese's past practice of passing "supposedly confidential information" from victims to Stradley Ronon. That law firm was defending the archdiocese in civil cases brought by alleged victims.


Joining Smith in her work has been Ballard lawyer John Grugan, as well as other lawyers from the firm. She said the dual tasks facing the Ballard lawyers and Toczydlowski made for intense workdays. "It's like changing the wheels on a bus while it's flying down the highway," she said.


Hired by Rigali on Feb. 15, Smith moved swiftly to see that accused priests were put on leave. In all, the archdiocese has suspended 29 priests, including three who face criminal charges as a result of the grand jury report.


She also quickly cleared eight priests, deeming the allegations against them too insubstantial to warrant action or further investigation.


Smith knows she is walking a fine line.


"There is an urgency to this process, but we can't allow the urgency to make us overreact," she said. "We have to be thoughtful and deliberate."


Her team will seek interviews with all the suspended priests, look for possible witnesses, and hunt for evidence to corroborate or rebut a complaint.


Asked about victim interviews, Smith said they would be sought on a case-by-case basis.


In some instances, she pointed out, priests may simply admit wrongful conduct, sparing victims from having to retell painful stories of abuse. "This process is not designed to revictimize those involved," she said.


In other cases, the original complaint may have been leveled by someone other than a minor, such as a parent, or brought decades ago. The victims might not want to talk, she said. "Some may have made a choice to move on."


Smith said she did not expect to make a public announcement on the cases even as she forwards her recommendations to Rigali, case by case. She said she was sure the cardinal would identify the priests he disciplines.


Toczydlowski, a former deputy district attorney with 30 years' experience as a prosecutor, said that the path ahead is straightforward.


His goal, he said, is "to try to make sure this doesn't happen again, to make sure that there is never going to be a third grand jury."

Tallman wants to stop airport body searches

State Rep. Will Tallman, R-Reading Township is hoping to put a stop to what he calls "unconstitutional invasions of privacy" during airport security searches.

Tallman introduced a bill in the state House that would make it a crime for an airport security guard to touch a person's genitals and breasts during security checks.

Those performing the checks could be charged with indecent assault, a misdemeanor offense, if they touch a person's private areas, under Tallman's proposal.

Federal, state, or municipal employees would not be immune from prosecution, Tallman said.

Tallman was one of five representatives who introduced the bill. Texas and New Hampshire legislators have introduced similar bills in their respective state houses.

Tallman said the Transportation Security Administration searches go above and beyond what is necessary when boarding a flight and state legislators need to take a stand on what he calls infringements to the Pennsylvania and U.S. Constitution.

"Why are we subjecting our citizens to this invasion of privacy?" Tallman said.

Anne Davis, a TSA spokeswoman, said she could not comment on pending legislation.

Hassles: If the bill is enacted, enforcement would fall on the county where each airport is located, Tallman said.

For example, he said if a perceived infraction occurred at Harrisburg International Airport, the Dauphin County district attorney's office would investigate allegations and file any necessary charges.

In January, Tallman flew out of Harrisburg International Airport and opted for a pat down to see what it was like.

He said he was alarmed by the procedure.

"I found it to be an invasion of my privacy," Tallman said.

At security check points prior to boarding, travelers have the option of going through a full-body scan or being patted down. Health and privacy concerns about the full-body scan have been raised.

Tallman also presented a resolution that calls on Congress to address concerns raised by screening methods used by the TSA. Seven other representatives co-sponsored the resolution.

Too far: On Wednesday, the House government committee held a hearing on TSA searches where representatives from political advocacy groups, such as the ACLU and the Cato Institute testified against the searches, Tallman said.

State Rep. Seth Grove, R-Dover Township, also sat in on the hearing and said he believes the TSA is going too far when it comes to searches.

A representative from one of the groups testified that women, particularly attractive women, are selected for pat downs more often than men, Grove said.

Female TSA agents conduct pat downs on women, he added.

He said he'd like Congress to address the concerns and is in favor of Tallman's bill and resolution.

Grove said he has concerns over personal privacy during pat downs and with the full-body scanners. Also, he added, he has issues with images captured by the scanners being kept, especially images of those who, by all accounts, have done nothing wrong.

"I think airport security has been reactive rather than proactive," Grove said.

Shortly after the commencement of the Libya bombing campaign on March 19, the Pentagon ordered the testing of the B61-11 nuclear bomb. These tests announced in an April 4 press release, pertained to the installed equipment and weapon’s components. The objective was to verify the functionality of  the nuclear bomb…..

The B-2 Spirit Stealth bomber is the “chosen carrier” of the B61 -11 nuclear bombs. The B-2 Spirit Stealth bomber out of Whiteman Air Force Base in Missouri was not only sent on a mission to bomb Libya at the very outset of the air campaign, it was subsequently used in the testing of the B61 Mod 11 nuclear bomb.

The B61-11 has a yield of two thirds of a Hiroshima bomb. Why were these tests of the equipment and functionality of a tactical nuclear weapon scheduled shortly after the onset of the Libya bombing campaign?

Why now?

Is the timing of these tests coincidental or are they in any way related to the chronology of the Libya bombing campaign?

U.S. Air Force Global Strike Command, which is responsible for the coordination of US bombing operations directed against Libya was also involved in the testing of the B61-11 nuclear bombs.

Both the bombing of Libya by the B-2 Spirit Stealth bomber (see image above) on March 19-20, as well as the testing of the functionality of the B61-11 nuclar bomb (announced April 4) were implemented out of the same US Air Force base in Missouri.

Thinking the Unthinkable. The Pentagon’s Plan to Nuke Libya



The Pentagon had envisaged  the use of the B61 Mod 11 nuclear bomb against Libya. Categorized as a mini-nuke, the B61-11 is a 10 kiloton bomb with a yield equivalent to two thirds of a Hiroshima bomb. The Pentagon’s 1996 plan to nuke Libya had been announced in no uncertain terms at a press briefing by Assistant Secretary of Defense Harold P. Smith:

“[The] Air Force would use the B61-11 [nuclear weapon] against Libya’s alleged underground chemical weapons plant at Tarhunah if the President decided that the plant had to be destroyed. ‘We could not take [Tarhunah] out of commission using strictly conventional weapons,’ Smith told the Associated Press. The B61-11 ‘would be the nuclear weapon of choice,’ he told Jane Defence Weekly. (The Nuclear Information Project: the B61-11)

Clinton’s Defense Secretary William Perry –who was present at the press briefing– had earlier told a Senate Foreign Relations Committee that “the U.S. retained the option of using nuclear weapons against countries [e.g. Libya] armed with chemical and biological weapons.”(Ibid, See also Greg Mello, The Birth Of a New Bomb; Shades of Dr. Strangelove! Will We Learn to Love the B61-11? The Washington Post, June 01, 1997)

The Department of Defense’s objective was to fast track the “testing” of the B61-11 nuclear bomb on an actual country and that country was Libya:

“Even before the B61 came on line, Libya was identified as a potential target”. (Bulletin of the Atomic Scientists – September/ October 1997, p. 27). (For further details see Michel Chossudovsky, America’s Planned Nuclear Attack on Libya, March 2011)

While the 1996 plan to bomb Libya using tactical nuclear weapons was subsequently shelved, Libya was not removed from the “black list”: “The Qadhafi regime” remains to this date a target country for a pre-emptive (“defensive”) nuclear attack.

As revealed by William Arkin in early 2002, “The Bush administration, in a secret policy review… [had] ordered the Pentagon to draft contingency plans for the use of nuclear weapons against at least seven countries, naming not only Russia and the “axis of evil” Iraq, Iran, and North Korea but also China, Libya and Syria. According to the 2001 Nuclear Posture Review, adopted by the Senate in 2002, Libya is on the “Pentagon’s list”. Moreover, it is also important to emphasize that Libya was the first country to be tagged and formally identified (at a Department of Defense press briefing) as a possible target for a US sponsored nuclear attack using the B61 Mod 11 nuclear bomb. This announcement was made in 1996, five years prior to the formulation of  the pre-emptive nuclear war doctrine under the Bush administration (i.e the 2001 Nuclear Posture Review)

The Testing of the B61-11 Nuclear Bomb (Announced on April 4, 2011)

What is the relevance of the history of the B61-11 nuclear bomb and earlier threats directed by the Clinton administration against Libya?

Has the project to nuke Libya been shelved or is Libya still being contemplated as a potential target for a nuclear attack?

Shortly after the commencement of the Libya bombing campaign on March 19, the US Department of Defense ordered the testing of the B61-11 nuclear bomb. These tests pertained to the installed equipment and weapon ‘s components of the nuclear bomb.

The announcement of these tests was made public on April 4; the precise date of  the test was not revealed, but one can reasonably assume that it was in the days prior to the April 4 press release by the National Nuclear Security Administration (NNSA. Press Release, NNSA Conducts Successful B61-11 JTA Flight Test, Apr 4, 2011,)

The B-2 Spirit Stealth bomber is the US Air Force’s chosen “carrier” for the delivery of the B61 Mod 11 nuclear bomb. In late March or early April  (prior to April 4), the B-2 Spirit Stealth bomber from the 509th Bomber Wing operating out of Whiteman Air Force Base, was used in the so-called “Joint Test Assembly” (JTA) of the B61 Mod 11 nuclear bomb.

In other words, the B61-11 was tested using the same B-2 Spirit Stealth bombers out of Whiteman Air Force Base, which were used to bomb Libya at the very outset of the air campaign.

The Joint Test Assembly (JTA) of the B61-11

This JTA testing was undertaken by the National Nuclear Security Administration (NNSA) together with the U.S. Air Force Global Strike Command, which coincidentally is responsible for the coordination of US bombing operations directed against Libya as well as ongoing operations in Iraq and Afghanistan.

“The JTA was produced by the NNSA in support of the Joint Surveillance Flight Test Program between the Department of Defense and the NNSA” (Press release, op cit)

The Joint Test Assembly (JTA) in the case of  the B61 Mod 11 nuclear bomb, requires testing the equipment of the B61-11 using a proxy conventional non-nuclear warhead. Essentially what is involved is to test all the installed equipment on the nuclear bomb and ensure its functionality without actually having a nuclear explosion.

The JTA test “was built to simulate the actual B61-11 weapon configuration utilizing as much war reserve hardware as feasible.  It was assembled at the Pantex plant in Amarillo, Texas and was not capable of nuclear yield, as it contained no special nuclear materials.”  (Press Release, NNSA Conducts Successful B61-11 JTA Flight Test, Apr 4, 2011)

“JTA tests [are to ensure] that all weapon systems [e.g. B61-11 nuclear bomb] perform as planned and that systems are designed to be safe, secure and effective,”…. A JTA contains instrumentation and sensors that monitor the performance of numerous weapon components [e.g of the B61-11] during the flight test to determine if the weapon functions as designed. This JTA also included a flight recorder that stored the bomb performance data for the entire test. The data is used in a reliability model, developed by Sandia National Laboratories, to evaluate the reliability of the bomb. (Ibid)

This has been one of the most difficult blog entries we’ve written. In order to gather the most thorough evidence to date, we poured through countless news stories from Japan and the World, as well as official press releases from TEPCO, NRC documents, Areva status documents, and a JAIF report in order to determine the truth at Fukushima.

We had assumed that since the IAEA is an international organization, it would have the most honest report, but that doesn’t appear to be the case. What you’re reading took numerous hours of research over many days to discover the theoretical timeline of Plutonium radioactive isotope leakage at the Fukushima Daiichi facility.

There are two sources of Plutonium at Fukushima’s Daiichi plant.


  1. #3 Reactor was loaded with MOX fuel some four months before it was to be de-comissioned. This is strange in of itself.

  2. Plutonium is created in small quantities by the nuclear fission process in the spent fuel rods. Most of these are stored in the fuel storage pool at #4 reactor.

Plutonium disclosure happened over time as it was discovered or theorized by various parties. Bear with us as you read the chronology. There are many groups and experts involved: all of them discussing the implications of a plutonium leak.

Experts like Michio Kaku mentioned that Plutonium could be released from the MOX fuel, and then when the explosions began occurring so often (beginning on March 12), many nuclear experts stated that plutonium is a byproduct of the nuclear fission process. The explosions, whether hydrogen in origin or not, occurred at least five times over the month long course of the disaster.

Apparently TEPCO knew about Plutonium isotopes on 3/21 and 3/22. It was discovered in the soil around #1 and around several parts of #1’s infrastructure. No disclosure came at that time. True disclosure of that information only came out in the TEPCO press release on April 9th and through the Japanese Educational website about the disaster and reactor status (April 8th).

On March 23, experts were asked, on television and in the press, about the blue neutron beam, and stated that it might be due to the presence of uranium and plutonium radioactive isotopes, and an indication of spontaneous random re-criticality.

Plutonium was detected on 3/25 and 3/28, but the only reason we know this is from a minor footnote from a JAIF document which was only recently released on April 8th.

On March 26th, the NRC (The US Nuclear Regulatory Commission) analyzed the situation, but didn’t come right out say plutonium. Apparently based on the wording (read the chronology) they knew it though.

Here’s what is clear:

The 3/26 NRC document details neutron sources being thrown up to 1 mile and bulldozing of very high dose rate material being bulldozed between units 3 and 4. This means the US government knew about it and stayed silent. The New York Times broke that story on April 6.

On March 30th, the IAEA and a US dept of Energy official both documented possible Plutonium release in their statements.

The JAIF report wasn’t released until April 8th.

Milk from Little Rock and drinking water from Philadelphia contained the highest levels of Iodine-131 from Japan yet detected by the Environmental Protection Agency, according to data released by EPA Saturday.

The Philadelphia sample is below the EPA’s maximum contaminant level (MCL) for iodine-131, but the Little Rock sample is almost three times higher.

Nonetheless, the EPA does not consider the milk dangerous because the MCL is set for long-term exposure, and the iodine-131 from Japan’s Fukushima-Daichi nuclear accident is expected to be temporary and deteriorate rapidly.

The EPA’s MCL for iodine-131 is 3 picoCuries per liter.

Title of article now represents the minimum percentage that the radiation found in Hawaii is over EPA standards.

New EPA milk samples in Hawaii show radiation in milk at 800% above limits for Cs-134, 633% above limits for Cs-137 and 600% above EPA maximum for I-131 for a total of 2033%, or 20.33 times, above the federal drinking water limits.

New readings have also been posted for Phoenix AZ with milk being above the federal limit and Los Angeles with milk being slightly below the limit for Iodine.

Montpelier VT milk has tested positive for radioactive CS-137, above about 2/3rds the EPA maximum and Spokane WA milk testing less than half the limit for i-131.

A reader of my blog recently posted a YouTube video of my article on food contaminated with Japan nuclear radiation being sold on store shelves in California stores.

As reported live last night on the Intel Hub radio show and again today on The Alexander Higgins Show, Japan nuclear radiation including i-131, Caesium 134 and Caesium 137 are now being detected in a wide variety of foods being bought on store shelves in California. In the first food chain tests made public radioactive contamination was found in spinach, strawberries, topsoil, grass, and milk.


Of the isotopes detected, radioactive iodine has a half-life of 8 days outside of the human body and 100 days inside of the body. The C-134 ha a half-life of 2.0652 years and the c-137 has a half-life of 30.17. C-135 with a half-life of over 2.3 million years is not reported as detected.

Out of curiosity, I followed the link on the Radiation in US milk to see what the latest milk samples from the EPA contained and found the following.

So much for expert after experts saying we will only see traces of radiation and none at harmful levels in our food supplies.

In case you didn’t know, it has already been reported that radiation has been reported in the drinking water in 14 US cities.

The highest previous levels of radiation reported was Little Rock milk being 3 times the limit and Philadelphia drinking water at 73% of federal drinking water standards.

Obviously, as the video above points out radiation has been detected in the water, milk and food being sold on store shelves in California.

Editors Note: We are well aware that the EPA levels are gauged for yearly exposure but the idea that it is somehow safe to be way above accepted levels for at least 2 weeks is ludicrous.

UPDATE: All comments in regards to the 2033% number are completely irrational or outright lies. Let me put it this way, if its not 2033% total then ITS 800% OVER for Cs-134, 633% over for Cs-137 and 600% over for I-131. THIS IS WAY OVER THE LIMITS REGARDLESS OF HOW YOU LOOK AT IT!

Tokyo (CNN) — Beneath the cherry blossoms of Shiba Park, more than 2,000 people lined up for a Sunday afternoon march calling for Japan’s nuclear power stations to be shut down.

A week before, a similar protest — though in a chilly drizzle, not on a warm, sunny day — drew about 250.

And a month of frustration, desperation and anger boiled over at Tokyo Electric Power Company’s headquarters Friday as officials from towns around the Fukushima Daiichi nuclear power plant demanded to know when the crisis that has besieged their farming communities would end.

“The nuclear plant situation needs to be resolved as soon as possible. If not, we farmers will die,” one of the officials, Iwao Suzuki, told the utility’s executives.

But the response from Naomi Hirose, the managing director of Japan’s largest utility, offered little encouragement to the delegation or the rest of the world.

“There is a need to draw an end to the current situation as soon as possible,” Hirose said, adding, “We totally agree to this and are taking the utmost endeavors to contain the radiation.”

Since the March 11 earthquake that ravaged northern Japan, workers at Fukushima Daiichi have been struggling to cool down three overheated reactors and keep pools of spent but still potent nuclear fuel from spreading further radioactive contamination across northern Japan.

A month into the crisis, the utility acknowledges, there is no end in sight.

The problems are so far “beyond the design capacity” of the plant that the Japanese are working in uncharted territory, said Michael Friedlander, a former senior operator at U.S. nuclear power plants.

“No nuclear power plant has ever considered the inability to get on long-term core cooling for more than a week, much less three weeks,” Friedlander said. Read more…

Michael Ignatieff, leader of the Liberal party of Canada gets confronted about the Bilderberg group, the North American Union, and Fluoride. At a stop in Hamilton Ontario. For his part, Ignatieff answered the question about his opponent Harper’s Bilderberg visits and officially denounced secrecy.

Among Ignatieff’s sappy speech lines is that “It is time for a change.” Somehow, I think I’ve heard that before.
