Obama lacks authority to shutter Yucca site, court told

WASHINGTON--Lawyers for Washington state and South Carolina on Tuesday accused President Barack Obama of exceeding his constitutional power in closing the Yucca Mountain nuclear-waste repository.


Washington state Assistant Attorney General Andrew Fitz told a federal appellate court that Obama's refusal to fund continued development of the Nevada site violates the 1982 Nuclear Waste Policy Act.


"He's acting unconstitutionally under the separation of powers doctrine because he doesn't have the authority under the statute," Fitz told a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit. "He had no authority to reverse it."


In 1987 amendments to the nuclear-waste law, Congress designated Yucca Mountain as the central site for radioactive debris from the nation's 104 commercial reactors -- and from nuclear-weapons sites that have held even more toxic waste since the Cold War.


The government has spent $10 billion developing the Yucca site, but Obama has stripped funding for it from his last two budget proposals to Congress.


Republicans, who have proposed legislation to revive the repository, accuse Obama of making a political gesture to Senate Majority Leader Harry Reid of Nevada, whose residents dislike the notion of burying radioactive debris from across the country at a subterranean site 90 miles northwest of Las Vegas.


Washington, home to the Hanford nuclear reservation in the eastern part of the state, and South Carolina, which hosts the Savannah River Site on its border with Georgia, sued Obama. Aiken County, S.C., where Savannah River is located, and three businessmen in Washington state joined the lawsuit.


Other large former nuclear-weapons complexes include the Idaho National Laboratory and the Oak Ridge National Laboratory in Tennessee.


Chief Judge David Sentelle and Judge Brett Cavanaugh repeatedly challenged Fitz on whether the lawsuit by Washington and South Carolina is premature.


Sentelle and Cavanaugh said three administrative judges in the Nuclear Regulatory Commission in June rejected a bid by Energy Secretary Steven Chu to withdraw the Energy Department license to build and operate the Yucca repository.


The case has been before the NRC since then, with no indication of when the full commission will rule on the license withdrawal.


The judges and lawyers didn't address the merits of the case, avoiding the complex scientific and environmental issues tied to the Yucca site.


South Carolina Attorney General Alan Wilson echoed Fitz's courtroom claims in comments after the hearing.


"The government's decision to arbitrarily break federal law and derail Yucca Mountain is wrong and unconstitutional," Wilson said. "Congress passed laws to build Yucca Mountain as a safe repository for America's nuclear waste."


At Obama's direction, Chu set up the Blue Ribbon Commission on America's Nuclear Future in January 2010 and gave it two years to come up with an alternative to drilling deep tunnels beneath Yucca for nuclear -waste disposal.


"Nuclear-waste storage at Yucca Mountain is not an option," said Lee Hamilton, the commision's co-chairman and a former Indiana congressman. "The commission will be looking at better alternatives."

A North Carolina man was convicted of minting and selling his own coins, the Liberty Dollar, according to an announcement from the FBI.

Bernard von NotHaus, 67, created his own currency, some of which have Texas Republican Representative Ron Paul’s face on the front, and was found guilty after an eight-day trial and two hours of deliberation.

Von NotHaus used the Liberty Dollars in lieu of actual minted US coins and was found guilty on several charges stemming from making, processing, and using the imitation coins, the FBI said. He also was charged with conspiracy against the United States.

He started the Liberty Dollar company in 1998 and had the words “dollar, USA, Liberty, Trust in God,” said the FBI in a statement.

OKLAHOMA CITY – As airline passengers get groped and radiated while merely trying to get from Point A to Point B, the Transportation Security Administration continues to ignore the real problems that the agency faces – namely unprofessionalism and knee-jerk reactions to criticism.

And while we hear about the thuggish behavior of some TSA personnel, or the sticky-fingered government goons pretending to protect us from nogoodniks while stealing laptops, cash and more, we see a situation in a major American city that is beginning to makes some waves in Washington and bringing a spotlight to the security theater that is taking place at our nation’s aiports.

Specifically, I’m talking about the bizarre case of Delvonte Tisdale. If that name doesn’t ring a bell it’s because it quickly went down the media memory hole – one of those weird stories that defies a quick explanation.

And it involves serious security matters too.

Somehow, this 16-year-old North Carolinian managed to get through the security fence at the Charlotte/Douglas International Airport last Nov. 15 and proceeded to crawl his way into the wheel well of a US Airways Boeing 737 that was on a flight to Boston.

How did Tisdale do it? Why did he decide to stowaway? No one really knows because apparently when the landing gear was engaged over suburban Boston, he tumbled to his death, his body found in the suburb of Milton, Massachusetts.

Sadly, we have heard these stories before. Desperate people sneaking into airplane wheel wells, usually dying from a lack of oxygen and frigid cold temperatures as the jet flies high in the atmosphere. Again, we are not sure how Tisdale died. All we know is he wasn’t where he was supposed to be – exposing the fact that the Charlotte airport is not as secure as we are led to believe, some nine years after 9/11. Ironically, this plane was flying into Boston Logan International Airport where some of the 9/11 hijackers launched their attacks, if you buy into the official story.

U.S. Rep. William R. Keating, a Massachusetts Democrat, is starting to ask some tough questions about airport security.

In the Boston Globe earlier this month, in a story headlined “Tisdale death still baffles N.C. police,”we find Rep. Keating to be pretty upset about the whole sad story, particularly in the area of security and that Tisdale breached that security perimeter.

Keating, newly elected to Congress, is concerned that the TSA and Homeland Security are not eager to solve the Tisdale mystery. This, while they are introducing more and more of these dangerous and intrusive naked body scanners in our nation’s airports.

Keating had already told the Boston Herald that “(t)here has to be a sense of urgency on perimeter and tarmac security. To me, this is just hard to comprehend, that it’s still happening.”

And from that aforementioned Globe story: “We don’t want to wait until we’re looking back at a tragedy to say we had the opportunity to do something, and we did nothing,’’ said Keating, who was Norfolk district attorney when Tisdale’s battered body was found Nov. 15. “I remain astonished that more comprehensive action hasn’t taken place. The sense of urgency I feel doesn’t appear to be shared by Homeland Security.’’

The Globe continued noting that Keating spoke a day after Charlotte officials described, in somewhat vague detail, the findings of their investigation into the death of Tisdale. The North Carolina investigators did not have much to say at the time. And now, in an update on this story, Charlotte officials now admit that details of their findings were not “sealed, by the United States government,” as they admitted but wanted to make sure there was nothing in their findings that was “security sensitive.”

Again, the report on Tisdale was never ordered sealed. Sort of reminds me of the TSA not wanting to admit their mistakes in the radiation levels being emitted from their dangerous naked body scanners.

Note the Charlotte Observer editorial, “City undercuts itself with Tisdale secrecy,” where that paper’s editorial board ask the city of Charlotte to assure them and their readers that actual security issues be addressed.

This, while TSA and Homeland Security (and local officials in Charlotte) bungle this investigation, innocent Americans and others are being harassed, poked and prodded.

Forgotten in this story is the family of Delvonte Tisdale. On the Black Political Buzz website they report that Tisdale’s family has hired a law firm to “expose truth, negligence and national security risk.”

In a press release at that site, the Tisdale family attorney, Christopher Chestnut, writes: “(I)t’s now time this story be tiold and all facets of it explored – including the considerable ominous implications to our national security at large.”

It makes one wonder if this could happen here at Will Rogers World Airport or up at the airport in Tulsa?

And one can’t help but think of our perilous border situation where illegal aliens easily cross into the U.S. while American citizens have more and more of their rights abused or ignored by government “officials.”

So, is security really what TSA and Homeland Security is seeking? In the Tisdale case they were sleeping on the job long enough for this teen to stowaway on a plane at a major American airport. So, what else is happening right under their nose as they grab grandma’s breasts or tell your child to take off their shirt?

Efforts to restore electrical power and cool the overheating reactors at Japan’s Fukushima nuclear power plant suffer a setback after water pumps from reactor No.2 were found to be damaged beyond repair.

According to Japan’s official Kyodo news agency, reactor No.2 has faced a cooling failure due to damage to the reactor’s containment structure.

Some reports say the reactor’s cooling system has been permanently knocked out as a result of the 8.9-magnitude quake and the following tsunami which devastated Japan’s northeastern coast.

Japanese authorities are accusing Tokyo Electric Power Company (TEPCO) which owns the Fukushima plant of withholding information about safety violations and submitting “false” reports to inspectors.

According to the latest update by Japan’s National Police Agency, death toll from the quake reached 9,080 in 12 prefectures, while the number of missing came to 13,561 in six prefectures.

Work to restore power and cool down spent nuclear fuel pools at the quake-stricken nuclear power plant resumed Tuesday after being interrupted twice within 24 hours due to steam and smoke rising from the No. 2 and No. 3 reactor buildings.

Radiation levels spiked briefly, and engineers were told to leave the plant.

Defense Minister Toshimi Kitazawa told a news conference that he believes the smoke rising from the No. 2 reactor is vapor caused by water-discharging operations and that blackish smoke was briefly detected Tuesday at the No. 3 reactor as some rubble caught fire following the rise in temperature, Kyodo News Agency reported.

In reactor No.3, seawater is being pumped in to cool the heating systems amid fears of a partial melting of the core.

Experts consider any damage to the third reactor as potentially dangerous as the fuel rods are made of uranium and plutonium, which is highly toxic.

External power source has reached all the six reactors except for No. 3.

Industry Minister Banri Kaieda acknowledged during a press conference earlier Tuesday that progress in electricity restoration was good news, but the situation involving the reactors remained ”extremely tough.”

Geologists have warned that another powerful earthquake could hit Tokyo because the one that struck on March 11, which was of a size 9 magnitude, has altered the earth’s surface.

The monster quake has put pressure on the fault lines near the Japanese capital and experts have suggested that a size 7.5 magnitude earthquake could hit.

The structure of the tectonic plates and fault lines around the city makes it unlikely that Tokyo, home to 13million people, would be hit by a quake anywhere near the intensity of the one 10 days ago, said Roger Musson of the British Geological Survey.

But given the vast population – the capital and its surroundings are home to 39million people (including in the suburbs) – any strong tremor could be devastating.

‘Even if you’ve got, let’s say, a 7.5, that would be serious,’ the seismologist said.

Japan is located on the Ring of Fire, an arc of volcanoes and fault lines spanning the Pacific Basin, and is regularly hit by earthquakes.

Border Patrol agents recently arrested 13 illegal immigrants disguised as U.S. Marines and riding in a fake military van, U.S. Customs and Border Protection said Tuesday.

The illegal immigrants were clad in Marine uniforms when they were apprehended at the Campo Border Patrol Westbound I-8 checkpoint at 11 p.m. on March 14 near Pine Valley, Calif., border officials said. Two U.S. citizens in the van also were arrested.

After the suspicious white van was subjected to secondary inspection, it was determined that the driver of the vehicle and its front seat passenger were U.S. citizens who were attempting to smuggle 13 illegal immigrants into the United States. All of the vehicle’s occupants wore U.S. Marine uniforms, reportedly emblazoned with the name “Perez.”
