DOJ Weighs Supreme Court Challenge in GPS Surveillance Dispute
Justice Department lawyers continue weighing whether to ask the U.S. Supreme Court to pick up a controversial decision involving law enforcement’s warrantless use of GPS devices to track criminal suspects.
The U.S. Court of Appeals for the D.C. Circuit in August vacated the life sentence of a man named Antoine Jones, saying investigators should have obtained a warrant to install a global positioning device on Jones’ vehicle to follow him during a drug trafficking investigation.
The appeals court said the warrantless use of the tracking device, which produced thousands of pages of data and allegedly linked Jones to a drug stash house in Maryland, violated his Fourth Amendment rights. In November, the D.C. Circuit voted 5-4 to refuse to allow the full court to rehear the dispute.
Ever since then, DOJ lawyers have been mulling a Supreme Court petition. The deadline to file a petition, which had been today, was recently extended to April 15, Assistant U.S. Attorney Peter Smith said in court papers filed in the D.C. Circuit this morning.
Smith said any certiorari petition filed in the high court would present a substantial question of law. In the court papers (PDF) filed today, Smith noted that Chief Judge David Sentelle of the D.C. Circuit, who voted in favor of the full-court rehearing, said the panel decision conflicts with Supreme Court precedent.
Smith said there’s a “reasonable probability” that four Supreme Court justices will vote for certiorari.
A lawyer for Jones, Stephen Leckar of Washington’s Shainis & Peltzman, did not take a position on the government’s request that the D.C. Circuit stay the issuance of its mandate.
Leckar this afternoon said in an e-mail: “There is something incongruous with the Obama Administration’s calling for national privacy legislation to prevent retailers and others from compiling massive, exquisitely detailed dossiers on individuals’ buying habits on the Internet while arguing that its agents ought to be free to use GPS devices to track and compile similar dossiers on individual’s travel without the approval of a judge.”
Jones remains in federal custody pending a new trial in U.S. District Court for the District of Columbia.

Oil Spill Reported Near Deepwater Drilling Site in Gulf

The Coast Guard is investigating reports of a potentially large oil slick in the Gulf of Mexico not far from the Deepwater Horizon site. According to a knowledgeable source, the slick was sighted by a helicopter pilot on Friday and is about 100 miles long. A fishing boat captain said he went through the slick yesterday and it was strong enough to make his eyes burn.
According to the Times Picayune, the Coast Guard has confirmed they are investigating a potentially large 100 mile slick about 30 miles offshore. They are going to a site near the Matterhorn well site about 20 miles north of the BP Deepwater Horizon site, according to the paper. The Matterhorn field includes includes a deepwater drilling platform owned by W&T Technology. It was acquired last year from TotalFinaElf E&P.
Independent pilots are attempting to reach the slick today. Bonnie Schumaker with Wings of Care reported she saw a slick two days ago and is attempting to reach the site.

Thousands of Libyans packed into Muammar Gaddafi’s heavily fortified Tripoli compound on Saturday to form a human shield against possible air strikes by allied forces.
Fireworks erupted into the night sky and people fired defiant shots into the air at the compound after allied warplanes went into action in eastern Libya to stop the Libyan leader’s forces attacking the rebel-held city of Benghazi.
“Crowds are forming around the targets identified by France,” the Libyan state television reported, showing pictures of flag-waving people gathering to serve as human shields.
Last week, a highly placed French source referred to Bab al-Aziziya, a military air base, and another in Sebha in the south as likely targets of a strike.
Libyans from all walks of life streamed into the Bab Al-Aziziyah compound, shouting slogans and holding portraits of Gaddafi. Loudspeakers boomed songs praising the leader.
“My mother and father told me that they (Western warplanes) would attack the compound so I came here to protect our leader,” said one 10-year-old boy, Mahmoud.
About 1,000 kilometers (600 miles) to the east, French fighter jets were destroying tanks and armored vehicles to halt Gaddafi’s advance on rebel forces around their stronghold of Benghazi.
The huge Tripoli complex, which includes military barracks, was the target of a 1986 U.S. bombing of Libya. Then U.S. President Ronald Reagan said it was in retaliation for what he called Libyan complicity in the bombing of a Berlin night club.
The government took foreign reporters to the normally closed site on a rare visit to showcase people’s support for Gaddafi.
Inside the compound’s high olive-green walls, people danced to a song setting an oft-repeated phrase from a recent Gaddafi speeches — “house by house, alley by alley” — to a melody.
Nearby, a man watched the crowd from the back of a pick-up truck equipped with an anti-aircraft gun.
An image of a hand crushing an F-16 fighter was superimposed on the window of a house gutted in the 1986 attack. Men with AK-47 rifles stood nearby. Soldiers looked on from watch towers.
Gaddafi’s daughter Aisha paid an unexpected visit and stood on a vehicle as flag-waving supporters cheered her.
The gates of the compound, the heart of Gaddafi’s powerful security apparatus which is usually off-limits to the general public, were wide open, and people continued to stream into it throughout the evening.
“We are here. We are ready to die for our leader,” said Om Abdel Qadir, an Arabic language teacher. She said her six sons had all volunteered to fight for Gaddafi.
“Even if we do not have weapons, people will do everything they can to fight. You will see people on every street, pouring hot oil on the enemy.” Mahmoud el-Mansouri, a farmer, said people were angry.
“There are 5,000 tribesmen who are preparing to come here to fight with our leader. They had better not try to attack our country,” he said.
“We will open up Libya’s deserts and allow Africans to flood to Europe to blow themselves up as suicide bombers. … We are ready to attack embassies abroad.” Mustafa Abdelgadir, a 27-year-old man, added: “Everyone has weapons training and we are all prepared to fight.”

According to the security company, the virus is designed to target a German-made program often used in systems managing water, gas and oil pipelines. The program is used at public utilities around the world, including in Japan.
Here is a nightmare scenario for you.
4. As the above article documents, Stuxnet was in Japan last October, presumably still spreading and intended to wreck nuclear power plants.
So now the difficulty the Fukushima nuclear plant operators faced in recovering control over their runaway reactors takes on a darker significance. Remember that the first problem following the quake was that the automated shutdown systems failed to operate at some of the reactors, because pumps failed and valves would not open even while running on batteries; the very sorts of mischief Stuxnet supposedly was designed to cause at Iran’s power station.
Did we all just get hacked to death by Israel?

The shadowy group known as Bilderberg will be gathering this year for its annual meeting at the resort city of St. Moritz, in southeastern Switzerland, June 9-12, but they will have a lot of company. St. Moritz is a short distance from Davos, the site of the regular high-priced meeting of thousands of bankers, political leaders and other notables called the World Economic Forum. But unlike at Davos, where the press is always welcome, Bilderberg still tries to maintain absolute secrecy.
Bilderberg has met in Switzerland four times over the years but never in the same city. Normally, when their sibling in crime, the Trilateral Commission (TC), meets in North America, Bilderberg does, too. This year, the TC will meet in Washington on April 8 to 10, but the Bilderbergers are avoiding the United States, in what may be an effort to fool the press.
Bilderberg has been called the most exclusive and secretive club in the world. To be admitted, you have to own a multinational bank, a multinational corporation or a country. Since its first meeting in 1953, it has been attended by the top powerbrokers, financial minds and world leaders.
The Bilderbergers hope that part of their common agenda with the “Trilateralists” will be accomplished by the time they meet: a U.S. invasion of Libya to generate increased Middle East turmoil so America can go to war with Iran, on Israel’s behalf.
As has happened for several years, the Bilderbergers will blubber about how “ evil nationalists” are blocking their efforts to achieve world government. They will order oil prices to climb so desperate Americans might be made more willing to surrender sovereignty to a world government. They will promote wars for profit, and will advance the call for a world government to impose peace—as if peace can be imposed.
It is ironic that Bilderberg attendees love Switzerland so much because they are poles apart politically from Switzerland, which declared itself a non-interventionist neutral country four centuries ago. It has been involved in none of the world’s bloody wars since.
The Bilderbergers can expect to be loudly greeted by AFP, European news outlets and some in the U.S. independent media. In Europe, major metropolitan daily newspapers from Paris, London and other cities give major coverage to Bilderberg. But The Washington Post, The New York Times and The Los Angeles Times and their numerous chains will submit to muzzling because their top representatives are actual Bilderberg participants themselves.

As I’ve noted before, Libya is NOT our country’s battle, and we should have stayed out of it. It has absolutely NOTHING to do with freedom or American honor. On the contrary, it has everything to do with pointlessly forcing out the dictator with whom the U.S. had an agreement, a rapprochement, and from which the oil companies extract a lot of what eventually becomes our gasoline, and replacing that with Islamic extremists who are far worse than the Qaddafi devil we know. There isn’t even a purpose or plan in place.
So, why the heck are we wasting U.S. resources and spending billions to bomb the shores of Tripoli, as the U.S. began doing today with air strikes? More proof that we are just like Vladimir Lenin predicted in claiming we would sell them the rope on which to hang ourselves. Except he got one thing wrong. We didn’t sell the rope. Today, we are giving it away for free. And, actually, we will pay the expensive price for those fireworks, in oil, in leaders who make deals with us and whom we betray, in the horrid results of bolstering into power an Islamo-fascist government with people not wearing the wacky wardrobe of Qaddafi but the serious, focused wardrobe of HAMAS and the Muslim Brotherhood and the Al-Qaeda network. Perhaps Obama just wants to make things consistent, since the fellow co-religionists of his Muslim father have spread their population and extremism to the halls of Montezuma, too. You’ll note the U.S. and the other Allied Forces are not bombing south of Surt, because the areas south of there are firmly in the hand of the Muslim animals . . . er, “rebels.”
It’s ironic that tonight at sundown the Jewish holiday of Purim began (and I’ll post about that later). In the true story behind the holiday, there is an extremely foolish king, Xerxes I (Achashverosh, in Hebrew), who does the bidding of the evil Haman (the enemy of the Jewish people), signing decrees to send his armies to do battle against the Jewish people.
Today, Xerxes I is not in Persia. He’s the President of the U.S., and his name is Obama. For all his reputed “smartness,” the Harvard Law Grad is a fool a la Xerxes. Today, he sent U.S. planes and bombs–again, at a cost of billions to U.S. taxpayers who can’t afford it–to help the descendants of Haman take over Libya, so that they can harass the West, Christians, Jews, and Israel from a stronger, more powerful position. But even Xerxes, implored by Queen Esther, saw the error of his ways and took corrective measures to prevent what was to come. Obama didn’t and we’ll see the awful results for a long time, throughout the Middle East and at the pump.
And you can also blame Republicans and so-called conservatives like Sean Hannity, John McCain, and Mitch McConnell, all of whom demanded Obama help the Libyan “rebels” (translation: HAMASniks, Libyan edition).
Just wait for $6-$8 per gallon of gas when the “rebels” take over. Vladimir Lenin is smiling from his tomb.
I said it before, and I’ll say it again: the U.S. should have stayed out of Libya … and let allah sort it out. This isn’t our fight.
